Ohio Gov. John Kasich (R) signed stringent abortion restrictions into law as part of his state’s budget Sunday night, just days after Democratic Texas state Sen. Wendy Davis thrilled abortion rights groups nationwide with her successful filibuster against proposed anti-abortion regulations in her home state.
The provisions in Ohio will make it more difficult for family planning groups to receive funding for preventive care; require ultrasounds for anyone seeking an abortion; and limit abortion providers’ ability to get transfer agreements with public hospitals.
"And Republican policymakers in the state decided to redefine the words "pregnancy" and "fetus" in state law -- the budget decides that a woman is pregnant even before a fertilized egg is implanted in the uterine lining. The effect of this policy may prevent a woman from using an IUD in the state of Ohio."
What. the fuck. is this?
I'mma need to see the text of this.
Yes!

Sec. 2919.19. As used in this section and sections 2919.191 to 2919.193 of the Revised Code:
(A) "Fetal heartbeat" means cardiac activity or the steady and repetitive rhythmic contraction of the fetal heart within the gestational sac. (B) "Fetus" means the human offspring developing during pregnancy from the moment of conception and includes the embryonic stage of development.
(C) "Gestational age" means the age of an unborn human individual as calculated from the first day of the last menstrual period of a pregnant woman.
(D) "Gestational sac" means the structure that comprises the extraembryonic membranes that envelop the fetus and that is typically visible by ultrasound after the fourth week of pregnancy.
(E) "Medical emergency" has the same meaning as in section 2919.16 of the Revised Code.
(F) "Physician" has the same meaning as in section 2305.113 of the Revised Code.
(G) "Pregnancy" means the human female reproductive condition that begins with fertilization, when the woman is carrying the developing human offspring, and that is calculated from the first day of the last menstrual period of the woman.
(H) "Serious risk of the substantial and irreversible impairment of a major bodily function" has the same meaning as in section 2919.16 of the Revised Code.
(I) "Standard medical practice" means the degree of skill, care, and diligence that a physician of the same medical specialty would employ in like circumstances. As applied to the method used to determine the presence of a fetal heartbeat for purposes of section 2919.191 of the Revised Code, "standard medical practice" includes employing the appropriate means of detection depending on the estimated gestational age of the fetus and the condition of the woman and her pregnancy.
(J) "Unborn human individual" means an individual organism of the species homo sapiens from fertilization until live birth.

I'm also interested in this. I support my local clinic and they are also talking about this portion but don't cite it.

My god.
So we are always pregnant if we're not actively bleeding? WTMF. who the fuck does this guy think he is?
The way I read it is, if you have sex and an egg is "fertilized" you are pregnant. Starting with the last day of your period. No matter if that egg implants or not.
So...Uhh.....I guess if you're sexually active then you just have to assume you're pregnant all the fucking time.
I am honestly in so much shock I don't even know what to say. I hope I'm understanding this wrong.

I think we are all looking at this the same way you are.

WTF? You can't just change definitions and make laws that go against Supreme Court rulings for the hell of it. I know they want to overturn Roe v. Wade but this is ridiculous.
So effing glad I moved from Ohio shortly after SSM was made unconstitutional by the lovely voters in the state (minus Cleveland and Dayton, of course.)
Damn, they need more voters in Cleveland. This shit would stop.

is going to have. Because, take for instance IF treatment. This seems like a very dangerous definition to me.
This whole thing has me all upset and I don't even live in OH! And I never will, now.
Me too. It appears to grant all human rights to any fertilized egg, be it in a woman's body or a petri dish.
I wonder if those who wrote the law intended it this way (probably) or if they were just so dumb they didn't realize what they were writing.
ETA: The text of the bill uses "unborn human individual" not "fetus" or "embryo" in the bill itself. It is used everywhere. This is a personhood bill. No doubt about it.

It was absolutely intentional. The "Heartbeat Bill" failed last fall. It would have prohibited any abortion after a fetal heartbeat was detected. This is laying the groundwork for something even more restrictive.

With the line about making sure a pictorial representation shows scale, I wonder if they realize the impact that would actually have. Like, you're showing me that this
is a baby? And how will they show the scale when it's so small that there's really no way to picture how small it is.

This pretty much bans preimplantation genetic diagnosis (PGD - part of IVF for carriers of dangerous genetic conditions) and probably all the rest of IVF as well.
