I have to request the drug test some time today for D. So according to our mediator I should call him (which I'll do first and hope he doesn't answer so I can leave a VM), text him, and email him as well. He's set up with a facility in his area between 8-5 so he can take it there. He essentially has 24 hours to get it done.
I'm a little concerned about the fallout from doing it but it is what it is. I will probably request the test around 4pm so then he'll have basically all day tomorrow to get it done. At least after I request it P and I have a bday party to go to so I won't have to be around my phone.

Update: I just talked to him to request the drug test. Surprisingly he agreed to it HOWEVER when I told him that he had to go to a specific facility he wigged out. I hung up and then texted him the address of the facility and then emailed him. My guess is the place that HE wants to go is more lenient or he knows someone there. He definitely didn't like the idea that I already had the facility picked out.

Too bad for him...ugh! Just curious, is it urine test only? There are ways people beat the system on those, unfortunately. I don't know if they'd go as far as blood testing in such cases and depending on local laws.

Are we hoping he fails so you have more leverage in court or are we hoping he passes (although it would be suspicious that it was a legit clean test)? Either way...GOOD LUCK!!

Whoa...wtf to his freak out, but I'm sure it probably is that he wanted to go somewhere he already knew and could get someone to "fill in" for him. Maybe whatever place he wanted to use let you test totally alone and he could fake the results.

It's written in our court docs that if I request it he has 24 hrs to comply. It's a urine test but the reason I want him to go to the specific facility is because it has an excellent reputation. My friend is the owner of a compliance drug testing place. She said this particular facility will not let him get away with anything.
I hope he fails actually but it's kind of a mute point because I've still got enough from the schools to put in an emergency order for supervised visitation

Under what circumstances can you request a drug test? Is it written in the court order? What happens if he doesn't comply?

I put it in my declaration as to why unsupervised or hell even supervised visitation would be a bad idea for stbxh and dd due to his ongoing drug issues. I requested that in the event he is granted ANY sort of visitation that he's drug tested 24, 12 and 2 hrs prior to any visit and any failure nullifies the visit.
As a part of his sentencing for violating the restraining order I have against him - he's subject to random drug testing by the Court and any test failure or failure to comply w the test will result in either court ordered rehab or jail time depending on what he does or doesn't do.

He texted asking for my address today and then said "there you go thanks for wasting my day" so I assume he took it. what I didn't know is WHERE he took it.
I told my attorney that he was balking at where I requested he test. He agreed it sounded really suspicious. So I'm not paying for it if a negative test comes back from where HE wanted to go. I don't trust him or the facility.
I also got the report from P's first school and I'm going to have the second school do a formal report and the counselor as well. I'm just gathering what I need to move forward with supervised visitation regardless of the drug test results. Whatever he's doing (and I STILL think it's drugs) is dangerous for P to be around.

I'm sorry he's being a dick. . Is he still seeing the girl he was dating a few months ago? (This is mostly curiosity, although if the relationship fell apart it could have triggered a relapse I guess).
