I don't usually drink anything while eating my meal, so kids sizes are perfect for me. My drink usually leaves with me if in a to-go cup. There is nothing wrong with you drinking a drink you paid for. Soda is so cheap for restaurants.
This is not wrong. It would be wrong if you asked for a water cup, no soda cup kid or otherwise, and didn't drink water but got soda instead. I called some guy on that the other day at chipotle.
The thing is that the kid's cup is the same as the water cup, so you (as a fellow customer) would not know that I paid for a kid's cup and it would look like I asked for a water cup and then filled it with soda. I think that this is what DH was worried about (that other customers would think that we were stealing) more than what the employees thought.
