this is where I'm at .. I'm DIY'ing mine and every order that I've got I've looked at before I left the courtroom to make sure that there are NO ambiguities. I don't want xh to have ANY wiggle room or have there be any loopholes for him to exploit bc lord knows, he will.

when I got the CPO (criminal protective order) from the DA's office I reviewed it and saw that a box wasn't checked off re service. when I got to my office, I called the DA and asked if xh was either present at the hearing or someone from the sheriff's office had personally served him as I wanted to make sure every I was dotted and t crossed just to avoid your situation. the DA confirmed that he was at the hearing that the box was missed, I had the DA's office send me a revised order w/ that box checked.

another pp is right that paying clients come before pro bono ones. that's how it works in my firm - the paying ones get the most attention, the non paying ones they fit around. I think its time you got counsel, ask for recs and take it from there. most firms will let you pay over time so you're not stuck paying HUGE attorney bills monthly. in your situation w/ a functional addict, I'd get 'real' counsel. he's playing dirty and knows it .. don't let him get away w/ it.

No I left. Actually I have a parent teacher conference in 5 minutes.

I'm finally calming down a bit. We're writing a letter to xhs attorney to document that it isn't our intent to withhold P or alienate xh. If the judges intent was for xh to continue visitation then we will give him extra time at Christmas to make up for the missed visitation this week

I also called the das office to say the same thing and they documented everything. They said the good cause letter isn't necessary because our court date is so soon. But at least it's documented.

Can you get documentation from the teacher's which identifies the dates that they had issues with P? I'm not sure but thinking it could be helpful to prove that they align with xDB's visitation times?

We have the documents from the principals office. Most of what occurred was after he spent Labor Day with xh.

Thanks everyone. I feel better now. I liked the letter my attorney sent to xhs attorney. That's our recourse that we aren't trying to keep him or alienate P. If the judge rules against our order xh can have make up visitation.
