The divorce hearing did not go well today. The judge said the division of assets and debts was not equal and he legally has to make sure it's equal. Everyone thought it was ridiculous and apparently afterwards he was telling the clerk that he felt badly about it. If I'd accepted judgment today I would've had to pay stbxh $1650. So the woman who coordinates the program I'm in is going to do the martial settlement agreement for me and then I'm going to make sure stbxh signs it in front of a notary so that I can get this shit DONE.

If I hear "no" or "go away" one more time... Though the other day he was acting a fool (more dangerous jumping from coffee table, to chair, to sofa, and back again) and he went into time out. He's crying in time out "I'm not bad! I'm not bad, mommy!".

I can commiserate on all of this. My DD is 4 and pulls this exact same crap. It's like once she gets going, there's no stopping her. I'm hoping it's better at 5...

My lawyer gave me a laugh. We are working on my will and trying to get together with witnesses so we can all sign and notarize it and get it filed. In the same email as us trying to plan it, she invites me and DS to her DD's birthday party figuring we can get it done then. I won't have DS but I am still going. This isn't as weird as it sounds since my lawyer is also a friend and one of my bosses at renfaire. But an email going "Ok, I'm busy this weekend with DD's party. Ooh, I should invite you and DS! No gifts, just come and have fun" had me giggling.
I should clarify. When I said everyone thought it was ridiculous, I meant the woman who runs the program and the person she was on the phone with who received an email about my case. I was told that almost any other judge would have approved things as they were. It's all because my student loans don't count towards the division so my significantly higher debt doesn't matter. I wanted to cry in court.
I was honest with stbxh (mostly, didn't mention the payment the judge wanted) and it seems like he'll sign the martial settlement agreement and keep things as is. I'm relieved that the woman who runs the program will be doing the MSA for me. She is seriously awesome. Part of the reason she likes me and wants to help me is because of the stamps I used on the envelopes for the forms (leftover wedding stamps with our photos on them). She likes my evil sense of humor.

Would the 1600 be a monthly payment? If so, that's more than CS in many cases. Eep.

The $1660 (the actual amount) would be the total I'd have to pay him/give him in assets to equalize. I think I told the judge that there weren't enough assets for that so the only way I'd be able to do it is to cash out my IRA and pay penalties. I think stbxh will sign the MSA though, so I won't need to do that.

I definitely hope that it works out in your favor, but in the grand scheme of things, that's not sooooo bad. Don't cash out an IRA. You will suffer all sorts of penalties (unless you have Roth? That would be better, but still not optimal). Try to work out a payment plan if you have to.

Reminds me of my friend whose divorce was finalized on their anniversary. The judge looked at the paperwork and said "uh, happy anniversary" and granted the divorce. It makes for a good laugh.
