Depends. Is there a big line for the women's room and none for the men? I'll use it. If I'm one away from the ladies' then I'll wait unless I'm in major need.
Depends on the kind of place. At a nicer restaurant I generally slip into the mens room. At the local bar or pizza shop where there are more men than women, I wait.
But I'll use the men's in some circumstances. If the women's is taking a really long time, I really have to go, and I'm in a more casual venue (at a bar; yes. At a fancy restaurant; no).

If I really have to go, and I am with a man who can stand guard outside, and I'm at least a little confident the men's room isn't disgusting, I'll use it. But the only men I'm ever with any more are my sons and OMG they would effing DIE, I mean literally, DIE, if I made them stand guard for me while I use a men's room. So I guess my answer is "Never any more but I used to."

LOL, I'm looking to avoid getting caught. Nice restaurants tend to have the bathrooms tucked away and the mens room tend to be identical to the ladies in terms of facilities and cleanliness. I am looking to avoid the scented urinal cake at all costs.
Divier places I frequent have the bathrooms in higher traffic areas or visible from the tables/bar.

I'm thinking more about whether people would care if they did catch me. Some dude at a bar is probably not going to care. A 60 year old guy with khakis and reading glasses is more likely to disapprove.
I'm with serenity a dive bar I will use the men's room and a nice place I will not. Unless I really have to go.
Also, MixedBerryJam why do you need a guard? Isn't there a lock on single stall restrooms everywhere?
Eh, I suppose I don't need one; I guess I don't want to pop out of a men's room all "Hey, Surprise!" unannounced in front of a line of menfolk. He wouldn't be a guard so much as an announcer.
