I am so sorry you are going thru all of this. We went thru the financial blender the last 4 years and lost everything, BK, Foreclosure, etc.. Due to DH not being able to work, medical bills, blah, blah, blah. We are OK, we came out in a much better place and are now rebuilding. I know the stress this brings to a family. Talk to your DH tonight and lay it all out. He needs to know and you both need to be on the same page and work on this together. (hug) (hug2)
Call the mortgage company first, see what happened to the big payment you made. If they went and dumped it in escrow/HO ins., see if they'll move that payment towards the principal. If they told you X number, you paid it, and they misapplied it, they ought to straighten that out before telling you they're starting foreclosure proceedings. I think they're at fault for giving you X number then not applying it towards the principal. If anything, maybe that will at least stop the foreclosure proceedings and you can apply for hardship programs?
Yes, I agree. I've heard of mortgage companies being dicks about this sort of thing before (if you did not specifically earmark it for principal in writing) but I would make them go back and look at their communication files to show that they told you the number you needed to pay, and you did.
And I'm so sorry. You don't deserve this type of stress on top of all the other BS you've been through.

Be very careful when you deal with your mortgage company, some are not honest at all. We were in bankruptcy due to my medical bills and H losing his job when the company he worked for went out of business several years ago. We were able to get it together and discharge early. Everything was paid off and mortgage was current (or so we thought). But, then since it was discharged early they pulled some crap where almost all the money we paid during the 3 years of bankruptcy went to fees and a bunch of nonsense. We were over 2 years behind on actual payments, we have paid a payment every single month since but if you look on our statement it still shows we are due for Feb. of 2014 right now, its crazy. I have spent hundreds of hours trying to get it worked out, they take no action to foreclose because we pay every month. BUT, now that H is not working and I won't be able to pay it next week I'm afraid we will be right where you are, they won't cut me any slack, they are a terrible company. And I talked to our bankruptcy lawyer at the time, we are stuck. Bankruptcy may be your answer, it worked for us, we paid everything and lost nothing, but be careful when you come out that your mortgage company is covered.

I'm so sorry this is happening. I really hope there is some huge mistake here that can be rectified with the right phone calls and documentation. It must be so stressful on top of everything else.

1. I'm not giving legal advice. I'm dumber than a box of rocks. You should never listen to anything I say.
2. Banks are the biggest fucking lying liars I have ever encountered with little to no accountability. So check your local county docket/go to the courthouse and see if they actually even filed a Complaint for Foreclosure. These matters are time sensitive.
2.5 Follow up in writing (and save a copy of what you send) with the bank to your request for documents. I like fax b/c I retain what I send and get a little confirmation page.
3. Contact an attorney that specializes in foreclosure defense. You may be better off paying an attorney over your mortgage.
And, can I just add how completely fucked it is that medical expenses in this country can, and do, bankrupt people or force them out of their homes? I'm all for physicians, hospitals, etc. getting paid, but not at the expense of someone's home.
My ILs have so much medical debt. They will die before they can pay it off and they're only in their 60s. It's so incredibly messed up.
OP, I'm so sorry! Please tell your H, tell trusted family or friends. Don't go through this alone.
I am so sorry (and I think I know who this is). No additional advice, but I hope you get all the data you need to clear this up and come out ahead. It sounds completely outrageous.
I'm back. I was put on hold with the mortgage company and had to go pick up DD so I just hung up. I'll call them in the morning, which will probably be better because I'll be more composed and have time to prepare my questions. I definitely am going to straighten out this "going to escrow" thing. I'll be requesting written copies of everything.
The GFM offers are so kind. I'd like a night to think about it to see if I can't come up with some type of solution on our own. And I'd have to be sure H was okay with it too. I don't mind talking about it here, but IRL I'm not going to deal with this until tomorrow--there's not much point anyway given that I haven't talked to the mortgage company to see what's really going on and if that truly is the amount we owe.
And for those of you who didn't get the earlier reference of the hearts, I'll go ahead and drop this here, because as I said, I suck at being an AE.
