H was parked outside a store waiting in our car with DS when a excavator construction truck backed into the front of our vehicle. Bumper/grill/front camera/sensors will need to be replaced plus whatever else they find in the inside. Our car was parked, the truck was backing up but not overly fast.
The owner of the construction company wants to settle this out of insurance, which seems like a pain to me, but H wants to. They have been easy to deal with, so far. Except when I mentioned that there was a car seat in the car and a baby in the car seat, the owner of the company didn’t want to replace the car seat because “I’m sure my driver wasn’t going very fast”.
They should be replacing the car seat, correct? We have a Clek Fllo and the manual says they “recommend” it be replaced.
If the manufacturer says it should be replaced, then it should be replaced. I would really hesitate to settle outside of insurance if there is any possibility that the baby could have been injured. Settling outside of insurance only benefits THEM, and doesn’t benefit you at all.
Definitely the car seat should be replaced. There could be hairline cracks in the car seat that would make it unsafe in a crash. I'd go through insurance. It only benefits them if you don't use insurance.

Yes it should be replaced if the manual says to (even recommended), especially when there is that much damage. I have only seen two types of statements from manufacturers: always replace and replace based on government defined ‘minor accident’
I’d try hard to talk my husband into contacting insurance if he was opposed. (We are in a fault state, we would not take a hit calling insurance) Especially with the refusal to replace the car seat. It’s going to get hairy and you don’t know if there will be injury symptoms down the road or any agreement about where it repair the car, use of aftermarket parts... Leave insurance to fight it out.
I called our insurance company and mentioned what happened and they said they would 100% replace the car seat, it’s just not a risk they would want to take, regardless of what the manufacturer says. I am going to speak to H and tell him I think we need to go through insurance.
We are in a no fault insurance province, this won’t have any bearing on our insurance rates since we are 100% not at fault. We won’t be OOP for anything and insurance will also pay for a rental vehicle. H is just such a people pleaser.

I would encourage you to just go through insurance.
A few months ago a young girl tapped my car pulling out of spot and scratched it. The only reason I kind of cared is because it's a lease vehicle and I didn't want it to potentially be something I have to pay more for when I turn the car in. The mom called me afterwards and begged me to not go through insurance. I agreed. I ended up getting a quote, but long story short I still haven't gotten my car fixed because it was just a hassle to figure out how to get the woman to pay for the rental car I'd need and to get the car to the shop, etc. Now I live in another state and don't drive the car very often, so I doubt I'll get it fixed. Dealing with insurance would've made it 100% easier since they would've made everything seamless. So don't be me!!
