Supposedly Wells Fargo is suing DH (not even sure if that's the right word, but I'm calling it suing). We haven't received anything directly from Wells Fargo, but we have gotten calls, emails, and paper mailings from their counsel. His parents have been getting stuff as well, I found out today. We don't know what he's supposedly being sued over, and had assumed it was fraud, but we now have a case number, and according to my attorney at work (who doesn't do litigation), she says it looks legit, but to see the paperwork, we'd need to actually go down to the court house, which neither of us have time to do unless it's something we absolutely need to do.
Is this standard? I would imagine that if you're suing someone, you have to actually provide them with official notification, right? Like getting served?
What do we even do with this? We've had two accounts with Wells Fargo, both were in good standing and paid off, and none that were in DH's name only. His credit report doesn't reflect any past due accounts or collection. Neither of us have had a single late payment in our lives.
DH's first name is very common, but last name not so much so. White Pages tells us he's the only person with his name in our county, although there are 42 of his name in CA. I'm not sure if some attorney is just blasting everyone in CA with Mr K3am's first and last name, or if this is something we really need to be concerned about.
Not a litigation attorney, and I have no idea. Did they give you any clues in the mailings, emails or phone calls on what it is about?
If you have official mail and your attorney says she thinks it’s legit can you try calling the number (if there is one in the paperwork) for a copy of the suit? I would try to do that before having to drive a long distance to go to the courthouse.
Again, I have no clue but I thought you would have to be served....
Maybe it’s related to his parents and his name just happened to be on an account since you all have no clue what it’s about. Do they know?

Are your court records only online in your county? Here in ours you can go to the court clerk's website and look up all the court papers that have been filed in a case.
yes they will eventually have to serve him with a copy of the complaint. \
What court is he being sued in?
And what kind of paper mailings did he get from their counsel if not a copy of the complaint or something saying what it was about?

And it turns out, WF is suing someone with his name in our county, but apparently that person has a different social and different address, and a bunch of debt collector agencies are just sending out official looking mailings (that AREN'T from WF or their counsel, but look like they are) to everyone with his name.
