I just learned on Nightly Show that Ice T was arrested in Colorado for "possession of a hoax device." It was a clock shaped to look like a bomb he bought in a novelty shop that housekeeping saw when they tidied the room.
I also learned that he didn't appear & just left the state.
Short answer: it depends. Police can question with probable cause, which they're probably claiming they had.
Parents don't have a right to be present when their kids are questioned.
Kids do, however, have Miranda rights and the right to counsel once they're in custody. And since all minors are assumed to be indigent, they all receive a public defender or court-appointed attorney.
I can totally understand why the English teacher thought it looked like a bomb, because it sort of does. But the reaction by the administrators and police was completely over the top and totally inexcusable.

what's funny is it looks like a bomb because the kid is a brown muslim boy. If a 14 year old white girl with a blond ponytail brought the clock to school everyone would be like, hey, cool clock!
If they are going to say that anything that "looks like" a bomb to the untrained eye is going to result in commotion and arrest maybe they need more strict rules around engineering projects for all children at the school.
If Ahmed was acting furtive or trying to hide the clock in any way, I could see being concerned. But if a kid comes up to you after class, pulls this case out of his bag, says the thing that beeped during you class was this clock I made and proudly shows it to you--you're telling me you'd still be worried that it was a bomb?
A kid building a bomb (or fake bomb to scare people) isn't going to show it off to his teacher.
And can we not forget that if anyone at any point thought that was an actual bomb, they would have been following emergency procedures for an evacuation.
I almost always back the school and admin, because, well, yeah, but this time someone done fucked up.
Someone on my FB page keeps replying to me with "But he put it in a briefcase! That makes a huge difference! He's stupid!"
How do I even respond to that?
One of the guys on the Nightly Show panel was hung up on that too. Are a lot of bombs transported in briefcases or something?
That's what I want to know, too. Weren't the Boston Marathon bombs hidden in backpacks? And the 1993 WTC and Oklahoma City bombs were in trucks, right? And that whole thing about the guy who tried to blow up a plane with a shoe bomb. Yet a suitcase is what makes someone figure OMGBOMB?
This kid was screwed no matter what. Yet my FB acquaintance keeps yelling that it's his fault for bringing it in a suitcase. Like he would've been so understanding had the kid brought it to school in a Vera Bradley duffel bag or something. *-)

The school district sent a letter home to families, and it's unbelievable tone-deaf. No apologies, and a reminder not to bring prohibited items to school? A CLOCK IS NOT A PROHIBITED ITEM!

If there was ever an imminent threat to your child, we would take immediate and necessary precautions, and we would inform you immediately. While we do not have any threats to our school community, we want you to be aware that the Irving Police Department responded to a suspicious-looking item on campus yesterday. We are pleased to report that after the police department’s assessment,the item discovered at school did not pose a threat to your child’s safety.
Our school is cooperating fully with the ongoing police investigation, and we are handling the situation in accordance with the Irving ISD Student Code of Conduct and applicable laws. Please rest assured that we will always take necessary steps to keep our school as safe as possible. I would like to know what people think that a clock looks like. I think it's sad that people get their information from the movies and not from STEM classes.

Really? No harm? What about this kid's scientific curiosity? His comfort level at school? His relationships with his classmates and teachers? They really think that's all going to go back to normal??

A kid accidentally left a homemade clock (school project) on the platform at our local train station earlier this year. They closed down the train station, suspended train service, and called in the bomb squad.
A photo of the clock landed on a local news FB page, and someone piped in "my son made that!"

You say it wasn't a briefcase. It was a pencil case. The purposely set it up to look like a briefcase. But if you look at the chair next to the thing for scale, it's obviously a pencil case. Plus, he said it was a pencil case.

I think to the untrained eye, which the English teacher was, the clock looks questionable, if it was presented exactly as shown in the picture. That is, I can see why a flag was raised in her head. But that's where my understanding stops! The teacher OBVIOUSLY let her gross biases against Muslim Americans cloud her critical thinking skills, if she had any at all.
1. He called it a clock not a bomb. 2. Would a kid with a bomb proudly present it to a teacher? 3. This kid is a geeky engineering student. 4. If she truly thought it was a bomb why did she take it from him and not, I dunno? Panic and get the school in lock down mode? 5. And if he intended it to be a hoax bomb why would he insist it was a clock? Like repeatedly?
It's so obvious EVERYONE reacted to his ethnic and religious background instead of using their damn brains. And I hope the school, law enforcement, and the govt get sued to high heaven. As they should.
