And the latest email, back to 'from the everly team' not her. I did NOT reply to the one from earlier... Also two rings are missing stones (three if you count the first pink) and I don't trust them, do I keep the dispute open?
Unfortunately, lately we have had a number of customers taking advantage of our willingness to make things right with our customers no matter what, hence the changes in our policies. We will handle your issue as follows. If you would like a refund, you will need to send back the rings in their original packaging and we will overlook the damages to the pink stoned ring due to manufacture error. In order for that return to happen in a timely manner, you will need to end the dispute with your credit card company. If you wish to continue with the dispute, you will still need to return the rings. They will be contacting us to finish the claim and we have a large paper trail stating that you have the merchandise you purchased and your claim will not go through. We would like to resolve the issue sooner rather than later so please let us know at your earliest convenience which option you would like to take.

I would ask Amex what they think the next move should be if you have already opened the claim.

The issue now though is they can tell Amex they offered to refund me and I didn't take them up on it. But they only offering to "overlook" the pink ring and not both defective ones and looks like I'd still have to pay to send them back

I cannot imagine that with a full paper trail on the Sheer Fuckery That Is Everly Rings that they'd consider this a genuine offer for refund. Talk to somebody at Amex. And document that call, too.

But they only did that AFTER the dispute. I'd wait on advice from AMEX.
