Jury selection was supposed to start this morning, but they sent the jury pool home. There are some issues with the potential addition of the 3rd degree murder charge. Short version- Prosecuting attorney is concerned moving forward with the jury selection without guidance from the court of appeals on another case (former officer Noor) may give the defense a reason to appeal.
The judge isn't thrilled and wants to keep the case moving along. So the delay could be a few days, few weeks or maybe even months depending on the outcome from the Appeals Court today.
So much of today is procedural items.
The protestors left the courthouse area when the jury pool was sent home and changed it to a march. There is also a group asking people to not come to George Floyd Square due to a shooting where someone died over the weekend.
So many moving parts to all of this and the city is insane right now. I am not concerned about any major issues until the verdict.
I'm already gearing myself up for this to go nowhere. I know how this will end and I would just once like to be surprised when a jury holds an officer accountable for a death he caused.

It's pretty sad I had to google to see which cop this was. I remember it was a cop involved in killing a black person, but in the intervening months my brain got fuzzy on which one as there are many, although once I googled I definitely remembered. I'm thousands of miles from US, so it's not covered. What is covered is also important because people are shit everywhere.
I'm just glad there's an attempt at justice. Don't find me holding my breath.
I'm currently taking a class called Ethnicity in the US and we have a chat room we need to enter a couple times a week. Some idiot kept calling this the George Floyd trial and I finally lost it on him today. I replied "George Floyd never had a trial, just an execution." Just sitting here waiting to see if the instructor keeps the duscussion open or will close it.
I understand skepticism by people. But, I have said since the beginning- this feels different. The protests felt different, the movement felt different, the energy feels different around this.

I would love nothing more than to be wrong here. But I distinctly remember thinking this about Tamir Rice's murder.

A Minnesota jury has recently convicted an officer--of course it was a black officer who shot a white woman--but we have had a conviction in recent memory. So I am optimistic here as it relates to Chauvin. I think convictions on the other three are pretty unlikely.
3rd degree murder charges were reinstated today. I think this is very important.
This is what he will be convicted of I presume. The added charge can sorta-kinda go both ways. As a defense attorney, the addition of that charge typically hurts us because it is usually the "compromised verdict." But, to the prosecutor it is somewhat of an assurance that they will be convicted of something and will do time.
The reality is a jury will have a difficult job convicting of first or second degree murder even though it was literally done on tape.
Pretty sure they're going to go HARD on excited delirium, so I don't have high Hope's about any justice really being served.
I have not heard anyone actually say he was experiencing excited delirium, at least none of the medical professionals. I think they are going to focus on the drugs in his system

Wasn't she also Australian visiting the US and so the case was getting worldwide attention? No way to sweep it under the rug.

The defense will go hard at that defense. Absolutely. I would do the same which is why that added manslaughter charge will be and is significant. Bottom line, it is difficult to convict a cop, while on duty, of first degree murder. Though premeditation can be made in seconds,no amount of jury instructions will really get through. They will see it as failure of duty and/or a true depravity of life.

It is bullshit but the reality of it.
I was talking with someone today about this, reality is the small little details/facts aren't that big of a deal. I think this is why the make up of the jury is important though. My experience in life (mid 40's white) is that cops are good. I was brought up to seek out cops if you were in trouble. We played cops and robbers where the cops were good and caught the bad guy.
Some may struggle to see that the cop that puts their life on the line every time they go to work, could do something awful. Thinking of putting someone away for 1st degree murder would be too harsh, but they would think 3rd is ok. He dedicated his life to public service. Emotions get in the way of the facts and details. Like you said, it is the bullshit reality of it all.
I was waiting for the fallout of the timing of the settlement. It is starting. Defense filed a motion to delay and move the trial because of the settlement. The belief that people will equate a settlement with guilt.

The defense isn’t wrong though. It’s really odd to me that they announced this settlement during jury selection. Why not keep it under a gag order until after the criminal trial. I equate that settlement with guilt 100%

Sounds like they interviewed the 7 current jurors regarding the settlement and dismissed 2.

And! It is worse than that. The AG, whose office is handling the prosecution, is Keith Ellison. His son is on the Minneapolis City Council, which had to approve the settlement and coordinated on announcement. I want Chauvin to be convicted, but this is just bad, bad behavior.

They've also made the point that the Justine Damond settlement wasn't announced until after the trial was over, right? It seems insane they couldn't have waited.
There is so much BS and power plays happening in Minneapolis surrounding these events it is crazy. Not very many of the players involved are acting like adults, they are acting like junior high students.
The city council is a joke right now, they aren't even sure who to pander to anymore so it is as they have just given up. I am pretty sure the majority of them were not prepared for the actual responsibilities that came with their office and title.

melmaria--totally true! And in that one everyone was fully on board with conviction, really, which seems influenced by race for sure to me.
keyslover--do NOT get me started on the mess that is the Minneapolis City Council. I LOATHE my councilperson and can't wait to try to vote him out. And the city is a mess right now related to crime, as well as race relationships. It is all powerplays and virtue signaling, and no one is really listening to anyone.
I've never seen the whole video and don't plan to watch it.
I know Jerry Blackwell through work and am so glad he's part of the prosecution team. He is a great guy and, more importantly, an extremely talented litigator.
