@@ I read this this weekend and have been sitting on it. The more I think bout it the more I think it would be struck down in the courts since states can't just take jurisdiction like that. BUT also, that kind of thinking is how these types of laws get passed in the first place and of course that doesn't help the people affected before and while it's going through the courts. My nibbling has family in FL, and goes to visit regularly.... if this is passed I don't think they could visit without fear. I know I'll be terrified the entire time they're down there that they won't be allowed to leave.
Part of the challenge with the courts is that I’m not sure we can count on the current SCOTUS to hold the line based on constitutionality vs their own ideology. If this FL policy is passed I’m sure it will be challenged, but I also hear the voice of one of the ACLU attorneys focused on these issues nationwide in the back of my head every day - they do not and will not have the resources and bandwidth to challenge every single one of these laws. There are too many, and even when there are challenges we can’t count on judges stopping implementation until the case is settled. These are things people take for granted as a backstop that are being cut away and undermined.
The FL legislation is the first time my blood has run cold out of truly personal fear. They’re going to try to take our kids and I no longer feel confident that the current power structures have the ability or the will to stop it.
