LOS ANGELES (AP) — Prosecutors in Los Angeles are reviewing new evidence in the case of Erik and Lyle Menendez to determine whether they should be serving life sentences for killing their parents in their Beverly Hills mansion more than 35 years ago, the city’s district attorney said Thursday.
I absolutely agree that had this happened today, they wouldn’t have received the sentencing they did. There is no doubt they killed their parents, but the rampant abuse they endured as children should have been a mitigating factor. I hope they’re released.
As someone who went to uni with one of them, I'd say they can rot in jail forever. Please do not quote. And I can't explain why as it has to do with some very person stuff.
But yes, the evidence may mean they shouldn't legally in this case.

For clarity - I think murder is wrong, obviously, but I also think that people who kill their abusers should have the psychological and physical damage taken into consideration when sentencing them.
I also think that the perception of how sexual abuse affects boys vs girls was very different in the 90s than it is today. Additionally, the second jury may not have heard about the abuse, which affected sentencing.
I think they likely would have gotten manslaughter if they had been tried today and would have been released by now.
I don’t think they should have gotten the sentences they did for killing their parents. I believe the other men who’ve come out to corroborate that José Menendez also horrifically abused them.
Maybe they’re a couple of real life douche bags. But they did t deserve the kind of abuse they received. No one does. Murder is a crime and should be punished, but again, I don’t think they deserve a life sentence for it in this case.
I’m interested to see what comes out with this new review.
I think based on all evidence of their pre-trial behavior that they're damaged, abusive people themselves. I don't fall for any of the crap that their supporters say about them being so kind and thoughtful and gentle. It's easy not to exhibit your worst selves and worst potential societal impact from prison.
I also think that mitigating factors for their actions were given insufficient weight in their trials vis a vis appropriate charges and sentencing.
I hold both of these things in my mind simultaneously. It's making for a conflicted response here.
