Are all the nude pumps patent?

I've been reading the nude pump threads, but when I look at some of the ones mentioned, I realize they're patent.

I was going to order the target pearce pumps and then realized they're patent.

Is this standard? Are there non patent ones out there? I can't do high heels though and try to stick to 3".

The taupe Pearce pumps are not patent.
