But they can't be reasonably expected to be there every second someone throws something down, especially inside the play structure itself. (I do realize this one was allegedly just on the floor. But in that case, the mom should have seen it and would be responsible for stopping the kids.) It's reasonable that they might not have had time to find it, depending on when the condom was thrown down.

I don't disagree, but I think in a lawsuit they're going to pay.
When lawsuits come up, I don't think about what's fair. The lady will sue, McDonalds will settle because its cheaper than fighting it and they don't want the bad publicity and the lady walks away with a sack of money. It doesn't really matter. I'm not a lawyer but it seems to be the way things go.
MWOS I need some science up in here. If I ate a sperm filled condom and pooped it out can it be determined from that stool sample that semen is present?

Well it's always someone's fault. Usually someone else's.
But clearly the real issue hurting her here, and I can't believe ML hasn't pointed this out yet, is that mom is going to have to overcome the fact that she decided to take her child to McDonalds.
