Didn't she just say JD? If she graduated law school she's a JD, isn't she? She's only an attorney if she passes the bar. At least that's my understanding.

From what I gather, if she hasn't passed the fitness review, been sworn in, etc. she can't call herself an attorney even if she graduated law school. To do otherwise is the unauthorized practice of law. Each state has different penalties and they take it pretty seriously when warranted. Fines for the most part, and you can be precluded from actually practicing as an attorney if found guilty of UPL because it may serve as a significant enough red flag to prevent passing the ethics and review but it depends on a lot of factors. For example, here are Illinois, Washington, Michigan and Ohio, picked for whatever reason I choose:
