Someone has asked me for advice and I just want to make sure that I'm giving her the correct information. Last night she was told by her first grader that a boy she knows was touching her inappropriately. The boy isn't in her class, but he goes to after care with her and has been doing it there. Evidently she once told the "teacher" (the after care people aren't actually licensed teachers) and all they did was put the kid in time out. No surprise it has happened again. Also since then the guy who oversees the whole program and the woman who led the 1st grade class have left so know no one who is there knows. I told the mom that she should first call the guy that oversees the program and then call the school director. However that is complicated by all the school staff being out of town until Wednesday. I asked her about talking to the boy's parent(s) and she said it wouldn't be received well and it wasn't something she is comfortable with. What else should I advise her to do? Also WWYD if you found out a child in your daughter's class was doing this to another girl?
Go to the administration of the school and they will report asap. I would also have her call CPS with the information she knows. Call CPS now, though, for sure.
Report to CPS immediately. A kid this young isn't likely to come up with this on his own (I'm assuming he is also in 1st) and maybe this will help him as well as the poor girl.
Is the aftercare in the school? If so, the people who work there are mandated reporters just by being employees of the school. Also, if the aftercare is considered a child care center or resource they are mandated as being child care providers. It's right here in the list you linked to:

For not reporting this, the people running the show over there could be in serious trouble.

Evidently CPS is who you call if the abuser is in the same house, and the police otherwise? Regardless she's calling the child help usa hotline first to talk to a counselor. Mom as also abused as a child and is having a hard time with the memories of that as well I'll make sure it's reported no matter what, even if I have to do it.
I would not send her back until I knew it had been taken care of. How are the caregivers not noticing this? Isn't aftercare usually in one big open room? I would call for an urgent meeting with the principal, the after-care teacher and the overseer of the program to ask that question and to see what they will be doing going forward to make sure they are never together or to have him removed from the program (if it was not just innocent curiosity).
She's not sending her back. It seems it's happened on the bus (they take field trips when school isn't in session for a full day) and on the playground. The principal and all school employees are OOT right now, so it will happen later this week.
In our training we were told to tell the administration but they would have the individual making the report make the call. The call is to non emergency local police unless there is the belief of imminent danger then 911. Don't try to rationalize or talk to the other party. Report and let them sort through it.
