If the BART police had been there they could've made him throw away his red bull, but that's about it. There is no drinking on the train, but the smoke was from when he was on the platform. Although I did once see someone roll a J on the train, but they didn't smoke it.
When I was in law school and my husband (then my boyfriend) was living on Long Island, I spent many a looooong Friday and Sunday afternoon on a combination of Septa, NJ Transit, and LIRR. Except for the (now closed ) Roy Rogers in the Trenton train station, those were some dark times.
I have to assume that the people sitting next to me were very happy that their train neighbor smelled like fried chicken and french fries. I'd certainly be happy.
