Ginsburg Accepts Her Cultural Brand at Dinner Honoring Her Work Katelyn Polantz 10/28/2015
U.S. Supreme Court Justice Antonin Scalia has an admission to make: Justice Ruth Bader Ginsburg is sharper at intellectual property law than he is.
“My judgment is often guided considerably by Ruth,” Scalia said in a tribute video for Ginsburg shown Tuesday night at a dinner hosted by the ChIPs organization for female IP lawyers.
Scalia’s remarks came in the context of praising Ginsburg for her grasp of intellectual property law. Yet his words and other tributes to Ginsburg on Tuesday night played up the lore and fandom that’s grown even in elite legal circles around the 82-year-old justice, her friendship with Scalia and her prominence among women professionals. The ChIPs organization, celebrating its 10th anniversary, inducted Ginsburg and her daughter, Columbia Law School Professor Jane Ginsburg, into their Hall of Fame.
“I am no expert in that field (intellectual property) myself,” Scalia said. “The only sense that’s reasonable for me to participate in this is I happen to be her oldest and best friend on the court.” The video clip showed him sitting in a wood-paneled room, presumably within the courthouse.
Ginsburg watched from a table at the front of the intimate dining room, filled almost solely with female tech executives, law firm partners and general counsels, in the Mandarin Oriental Hotel. The light tone of Scalia’s short remarks never hinted at the acrimony of last year’s term, which saw the court—and Scalia and Ginsburg—split over cases on same-sex marriage and the Affordable Care Act.
Scalia’s comments on video were followed by a YouTube-like video comparing Ginsburg’s personal preferences to the “Notorious R.B.G.” brand, which is also the title of a new coffee table book about the justice. Ginsburg wears a lace bib under her robes, for instance, but lawyers can wear “Notorious RBG” baby bibs when they eat spaghetti, the video advised. Ginsburg broke her gaze to laugh and comment quietly to her table when she saw Arnold & Porter appellate litigator Lisa Blatt on video drink out of a mug emblazoned with Ginsburg’s face and the words “Real tired of your homophobic shit” in rainbow colors.
Several colleagues in the law besides Scalia offered their tributes to Ginsburg in short videos, including Georgetown Law Center Dean William Treanor and Arthur Miller, a New York University School of Law professor who was classmates with Ginsburg at Harvard Law School and remembered babysitting a young Jane Ginsburg so her mother could study. Many praised Ginsburg for her role in social justice movements.
After the video, at least one businesswoman asked Ginsburg to sign her copy of the “Notorious R.B.G.” book. Others jostled for selfies and handshakes.
This was ChIPs’ 10th anniversary celebrating women who work in intellectual property and technology. The conference began Tuesday and continued Wednesday. Previous Hall of Fame inductees are Rachel Krevans and Lynn Levine of Morrison & Foerster and Judge Pauline Newman of the U.S. Court of Appeals for the Federal Circuit. Newman presented the Hall of Fame award to Justice Ginsburg on Tuesday. Newman, in keeping with the evening’s pop culture undertones, called Ginsburg a “notorious litigator and lawyer.”
I wasn't at the Tuesday dinner, but I was at the conference the next day and saw the Scalia clip. The award and the video was a lovely tribute to RBG and her daughter (who is quite accomplished in her own right).
