Florida Legislature tightens restrictions on abortion clinics

Voting along nearly straight party lines, the Legislature approved new restrictions on abortion clinics today, with a ban on any state health care funding for organizations that provide abortion services.

The proposal is similar to a Texas law requiring doctors at such clinics to have admitting privileges at a nearby hospital, which is now being challenged before the U.S. Supreme court. The bill (HB 1411) was sent back to the House for concurrence in a Senate amendment, and the House quickly approved it and sent the measure to Gov. Rick Scott for his signature.

Sen. Kelli Stargel, R-Lakeland, said her bill is not intended to outlaw abortion — which she admitted she would like to do, if the courts would allow it — but to end a “double standard” in clinic regulation. She said doctors doing colonoscopy or liposuction have to meet higher standards than those performing abortions.

But opponents of the bill, including all Senate Democrats, called it a barely disguised effort to prevent women from getting abortions. In Texas, 20 clinics were closed by the law now being challenged in the nation’s highest court.

Sen. Nancy Detert, R-Venice, was the only Republican not voting for the bill. She sided with Democrats who said women have a constitutional right to choose whether to end a pregnancy, and that infringing on that right through regulatory restrictions would be unconstitutional.

“Just because you took everybody’s ashtrays away doesn’t mean they quit smoking,” she said. “Just because we make it more difficult for people to get an abortion, or more expensive, doesn’t mean that those people who want an abortion aren’t going to try to get one.”

Stargel said her bill does not impose new burdens on women seeking abortions, but provides safety restrictions on clinics performing the procedure.

Republicans also rallied around the ban on any state Medicaid funding of clinics providing abortion. State law already forbids public funding of the operation itself, but about $200,000 goes to a few clinics for HIV testing, cancer screening, birth control and other health-care purposes. If those clinics continue providing abortion services, they would lose state funding for all purposes.

Sen. Alan Hays, R-Umatilla, said there have been some 60 million legal abortions across the nation since the high court effectively legalized the procedure in 1973. He said the state should not be a partner in any way with clinics providing abortion.

“If that’s not genocide, I don’t know what is,” he said.
