So H is pretty sure MIL didn't have a will (whyYY?!). There's no question he's next of kin as he's an only child but I have no idea how this stuff even begins to work. I mean sure, we have keys to the house so we can get in to get stuff, but legally, how does the process get started to have ownership for the house, car, and all accounts go into his name? Is it something the state starts automatically with the death certificate process or do we have to do something to get it started? I know with no will that it will take a lot longer :/
From what I know working at an FI you need the death certificate to do anything. If your h was named as beneficiary on anything you'll just need death certificate. If not you'll probably need a letter of testimentary naming your h executor of the estate since it sounds like her estate is over 100k (I think that's the current limit). Once social security gets notifed of her death you'll probably start getting tons of stuff in the mail. I would look into a financial advisor and or an estate attorney.you have a lot of work ahead and some big tax implications too I'm sure.
This is my territory. He will need to hire a probate attorney to file a probate. If he's the only child/beneficiary it will be easy. But in order for him to be able to do anything with her estate he will need to gain authority from the court by filing a probate and obtaining letters of administration. I'll PM you with my email and can send you a preliminary check list to get him going.

I know my husband is just coping and hasn't even wanted to start thinking about these kind of nitty gritty details and getting a bunch of it figured out is one way I could help.
