I have a contractor who just received an I-140. We want to convert this person to an employee but can't do so until he has his green card. HR think that will be 2-3 months out. My quick google-foo yields no decent timeline. Does anyone have a clue as to how accurate that timeframe is? I need to chart a course of action for him based on the how long this will take.
It depends on a variety of factors: country of origin and priority date to name a few. If he's from India or China you could be looking at close to 10 years. Would your company convert him if he had his 1-485 and was just waiting for his priority date to arrive?
I handle immigration issues for my firm and we are dealing with Green Card applications right now.
USCIS is a great resource. The Murthy Law Firm is also a good online resource.
Thank you both! He's from India. I don't think we can convert him until he officially has his green card. Not can't. Won't. New policy this year that my company isn't requesting - in any way - green cards for anyone.
