Deej was so wound up tight. Holy crap, she blamed her 'accidental' homophobic posts on her toddler (at the time). She was flamed away from GBCN for that among other things. She claims to be a devout Christian but then acts otherwise. I wouldn't put anything past her. I really DGAS if someone has met her or not - her actions speak louder than words.
I know rikki is out of the country, but I wonder what ever came of her reporting them.
They wrote me back and said thanks for the tip, but that there is nothing that they can do. I will copy it below.
They told me that she needs to be labeling each and every item as cooked in a home kitchen. I have no idea if she does this. I do recall her saying that she had her kitchen inspected, but according to the email from the woman, there is not a mechanism in place for this to be a true statement.
I responded and told them that she cooks barefoot and has her child and dog in the cooking area, but it appears that despite this, it is out of their control. They never responded and I wasn't really expecting them to, after her email to me.

Regarding your first concern, however, it would be more accurate to say that the Home Baked and Confectionary Goods Program is a state program and as such, its authority is limited to the state. Once an individual sells their product across state borders, this is considered interstate commerce and would be under the jurisdiction of the US Food and Drug Administration (FDA). And FDA, although it has jurisdiction over interstate sales of goods prepared in a private home, has opted not to regulate such establishments at this time.
Regarding your second concern, there is not a legal mechanism by which home bakers in the state of Arizona can have their operations inspected, suspended or closed. The law in Arizona requires that home bakers register, that bakers only prepare baked and confectionery goods that are not potentially hazardous, and that bakers properly label their products. One important aspect of the label is that it should state it is prepared in a private home. The onus really is on the consumer to decide whether they will consume an item prepared in a private home, which is not inspected.

rikki there is nothing on the labeling that indicates that they are prepared in a private home. Sadly, it sounds like even though she is not following the rules, there is no consequence for her.
