Teenage boy raped a visibly intoxicated girl who was slurring her speech at a party. He filmed it and shared the video with friends, and sent a text that said "when your first time having sex was rape."
(Male) Family court judge says this boy deserves leniency because he's from a "good family" and attended "an excellent school," and he was "clearly a candidate for not just college but probably a good college." Also, he said that he was upset that the prosecutors hadn't told the victim that pressing charges would destroy the boy's life.
The only bright point of this story is the family court judge was rebuked by the appeals court, who warned him that he was "showing his bias toward privileged teenagers" and allowed the prosecutors to try the teenager as an adult like they requested (and the family court judge denied because OMG what about the offender's college prospects??)
I mean, thank god for the appeals court decision, but WHAT THE FUCK:
Judge Troiano said there was a “distinction” between “a sexual assault and a rape.” He said “the traditional case of rape” generally involved two or more males using a gun or weapon to corner a victim into an abandoned house, shed or shack, “and just simply taking advantage of the person as well as beating the person, threatening the person.”
So in 2019, we're still fighting people who think it's not rape unless it's at the hands of strangers with weapons in an abandoned shack and the victim takes a beating as well. Awesome.

This was my first thought: I can’t imagine how this A-hole has ruled on the 100’s (1,000’s?) of cases in the past, because he FOR SURE wasn’t fair & just!

I have concerns about trying minors as adults in general but putting all of that aside, the judge's statements are horrifying. Fuck him and thank goodness for the appeals court.
To me, because he came from a 'good family' and has 'good prospects', I feel he should be held to a higher standard of behaviour not a lower one! If these are our future leaders, we should expect good behaviour from them. THis is just such a sad example of how the world looks after rich white boys.
Short answer: Yes. (Not often but it can happen. Saw one where there was a recommendation for removal of a judge for interfering in a custody matter in family court and then lying about it. Likely the lying, rather than the interference, was the reason for the recommendation. See: Clinton impeachment, lol.)

Come on, we all know the answer to that question. If they are a POC and poor we know they will get screwed. It is fucking amazing how open this judge is about it though.
I am glad he is only a family Court judge and that the prosecutor is pissed the fuck off.
I do wonder if that judge knows that kid and/or has a relationship with that family.

I'm so glad that the prosecutor knew to get the, usually closed, transcripts out in the open. It takes each person to fight this in the justice system to start any reform. He filmed himself? How are these boys so f-ed up about sex so early and so horrible?

And the part of the article where it said he was sending the video around to his friends, lied to her when she confronted him about it, and then CONTINUED TO KEEP SHARING IT AROUND?!? I was about to have a rage stroke. My heart breaks for her.

Wanted to share an update that Judge Troiano was removed from the judiciary. Nothing about this case is good, but I’m glad he’s no longer in his judicial seat.

It was at his own request so I suppose good for him rather than them.
From my understanding, he was retired when he'd heard the case; he was recalled from retirement to help hear cases and clear the docket. He's now permanently retired and won't be recalled in the future. Good news no matter how it happened.
