The updates include that she wasn't the county attorney when the case when to the grand jury.  The second update says "I never declined the case. It was handled and sent to the grand jury ... When I was county attorney, cases we had involving officer-involved shootings went to a grand jury. I think that was wrong, now. It would have been much better if I took responsibility and looked at cases and made a decision myself."  

I don't think she's the right choice and she declined to prosecute other officer involved crimes so she's got problematic behavior but wanted to clarify that the headline is probably incorrect.
