N.J. judge to decide if text sender liable for car crash. A New Jersey judge will likely soon decide whether a woman who sent a text message to a male friend can be held liable for a car crash he caused while reading the message.
The Daily Record reports the legal question stems from a lawsuit filed by two Dover residents who were seriously injured when a 19-year-old driver crashed into their motorcycle in September 2009. One victim had one of his legs torn off above the knee, while the other had her leg amputated because the injury was so severe.
How could she know he was driving? Its a little ridiculous in my opinion. If she KNEW he was driving (I.E. on the way to her house, business, etc.) then yes, she should be held somewhat responsible. BUT the driver is at fault because he chose to read the text message.

Um...no. How was she supposed to know he was driving at the time. It's his own dumbass fault for trying to read it. Texts can wait. That's the point of texts.

I agree, why should she be held responsable for some stupid thing that he did. He was driving, he should have waited to read. He should take responsability for his own stupidity and not blame someone else.
