Considering that he did it before while shaking his butt in a girl's face I think the suspension is warranted. I don't know how I feel about out of school suspension though. I think some kids think it is free days. Since the kids mom is defending him I'm sure that he won't be having a structured at home school day.
I think that he's not going to learn a lesson be having to stay at home. My high school had in school suspension and I think that would be the way to go. The teacher in charge of the suspension would discuss the reason that he was suspended, he would have to do some special work to show that he understands why he is being punished and that he is sorry for his actions. As well as this he would have to complete his school work. This would be in silence and without interaction with other children for the day. I think while he's at home he's going to get to watch cartoons and have fun, I don't see how that is going to help him in the long run.
I agree he needed to be reprimanded, but suspension isn't always the best way to keep this sort of thing from recurring. I wish that parents would take a little more responsibility for their children's actions and instead of defending them, let the children know that what they did is inappropriate and socially unacceptable.

Is it just me or does it seem like suspension was more of a big deal in the days when staying home meant having to plow fields or work in your father's business? If you want to punish a kid these days, wouldn't it make more sense to make the kid scrub floors or wash windows all day?
