And frankly it really bothers me when she reverts back to 'I'm not explaining this well' schtick. You explain it just fine, we just all think your being idiotic.
Yes!!! Schtick. That is the word I was looking for!
when he finds out that he has been paying her money he is not legally obligated to pay, can he sue her ass to get it back? assuming he doesn't want to just be a swell guy

Recap:
- Bree got a divorce, but needs to get off the mortgage on the house she and xh shared. - XH was supposed to pay her $xx,xxx but didn't have the cash upfront. He couldn't get a solo mortgage without paying that debt first. - Bree conspired with the loan officer (her mom's bff) to sign the document saying he had paid without him actually paying, but didn't bother to point out that he no longer owed her the money. Back doesn't know that he hasn't paid. - XH hasn't paid all the money still, but Bree is pissed that it is taking so long and now wants to charge him interest. - Cue backtracking and I didn't explain it well.
I probably forgot something, but those are the points I remember.
I assumed he'd be able to sue. I don't believe for one minute that he knows he is off the hook for this based on her OP.
He doesn't. He could find out if he wanted, but hasn't, and she hasn't told him.
It just kills me that she is going to play stupid and not tell him.
Yet she wants him to be a good guy and pay her, yet she cannot be a good person and tell him that he's not legally responsible for this. I fully believe that she's scared he will stop paying once he finds out, which is why she had to preface every other word with "he's a good guy" "he will pay" "I trust him" (not word for word) so that ML didn't point out she's being shady.
She was quite clear in her OP - pre backtracking - that he was unaware. Also that they have established a payback schedule and he has stuck to it.
Interestingly enough, she posted that he is having a baby with his GF and getting married (2 weeks after her) so maybe she should just email him a reminder that he has to keep paying no matter what. She thought maybe she would threaten to start charging interest...
Again - whoever said she is pissed that he moved on is exactly right here.

I actually read that before it was deleted, but I'm confused about her student loans. Why would he have to pay her back for those? Even if she took them out for cost of living. He wouldn't have to pay back a salary if she was working, would he? That seemed weird to me as well.
Is the XH paying per the agreed upon schedule and she is mad that its not faster? Or is he not paying on time (per their agreement)?
He was supposed to be done by December 2013, but came to her and said he wouldn't be able to make it and it would have to be March 2014. I get being angry about that, but she is the one who is fucking him over. She made mention of his new car, pregnant girlfriend and upcoming wedding, and his vacations. Clearly she wants her cash and he shouldn't be able to do anything else until it is paid.
I'm confused. Didn't she help him out by taking her name off so that he could get a loan? Why should he still not have to py when she did him a favor? Maybe I am totally reading this wrong?

How would it have helped him other than by taking her name off the loan, which she was rushing for her own credit's sake?

I don't know?? I'm going off of your recap and on my third glass of wine!! Tell me how the girl is shady so I can be on the same page as y'all! (yes, I used y'all)

No she did not help him out.
They were both on the mortgage. She wanted off after the divorce. Because he owed her so much money the lender said no, she could not come off. Her X doesn't have enough money for both debts so OP has to stay on mortgage.
OP sends lender a FAKE document saying her X no longer owes her money.
Lender says "oh! ok without that additional debt he can afford the mortgage without you. we will take your name off now!"
OP essentially tricked the lender into letting her off the hook. And sacked her X with a debt she AND THE LENDER knew he could not afford. And now has the balls to be upset that her shady fucking behavior means her repayments are late. Which is exactly what the lender was trying to avoid in the first place!
