UPDATE - we closed! Got it all squared away and got the roof contractor to sign a waiver of lien, so now I just have to make sure he gets paid and we're all good. Oh, and we sold the house! Woohoo!
OK, bear with me:
Got a new roof on the house we were selling after buyers claimed they couldn't get it insured. Insurance assessed with contractor, determined prior hail/wind damage, greenlighted replacement by contractor.
Contractor got it done in two days. Insurance issues an initial check payable to me and to lender - not contractor. Called lender, they sent me a packet with paperwork to send back in with the check and with a waiver of lien by contractor.
Spent the next two weeks trying to call contractor to get these documents - due to major storms in the area they've been doing 15-20 houses per day and now they're finally responding indicating they'll complete the paperwork.
So, as of today, the day before we close the sale, I don't have their documents and have the initial check in my possession but can't do anything with it since it needs to be processed by the other payee, the lender.
Lender is aware of this time dilemma, they ordered a final inspection earlier this week and indicated they'll work with us to get the contractor paid.
Realtor says if we can get a waiver of lien document from the contractor to our lender today, we may still be ok. Thoughts?
This is going to make me sick, no lie.
Update: roofing contractor got me the documents today, I faxed them & overnighted them to lender, and we should be golden. Whew!
