I just found out last night that XH totaled his truck and got a DUI charge. Don't worry ladies, he walked away without a scratch, though. I'm disappointed, but not surprised at all. Of course, as part of his sobriety (of a little over a year) he claimed to not be drinking either.
I am so upset because he has been taking P with him. I would never have forgiven myself if something happened to him when he was with XH.
I'm not sure where to go from here (visitation wise) because XH technically has all day Sunday visits now, but I am going to call my laywer this morning. I already told XH he could see P on father's day at my house for a supervised visit and that's it.
::sighs:: why does he have to be such an amazing doucheface?

I denied visitation to my XH once but I was pretty certain that if he took me to Court on it the repercussions would be minimal. The weekend before when he had visitation he had left the kids outside alone, the youngest one fell in the pool and when he got out there he yelled at my oldest (who was SEVEN at the time!!!!) for letting her little sister fall in the pool. Now, while I was pretty sure that THAT would never happen again, my oldest was so upset that she didn't want to go with him the next time. So I didn't make her. I was pretty sure that if he took me to Court for violatiing the agreement, that I would either prevail or be let off with a slap on the wrist given the circumstances.
My opinion (and only an opinion!) would be that if you deny visitation, what's going to happen? Probably nothing. I can't imagine a judge coming down really hard on you for not giving your XH visitation so soon after a DUI, if at all. So it might be worth the risk.
And if he has no truck, is it likely that he is going to be able to exercise visitation?

Wow...and just when you'd think he was maybe starting to turn a corner just a bit. And I remember a few weeks back when you posted that you thought you smelled beer on him.

If there's any bright side to this situation, it's that SD is proving (once again) that he hasn't changed his life. I hope that the courts can adjust his visitation accordingly. If he got another DUI, he likely doesn't have a license as they suspend/restrict them immediately. That alone is enough of a reason for you to insist on supervised visits.

I feel so sad for P
Apparently they let him keep it for 30 days. So he was like "oh I can drive with P until then". Ummmm, how about fuck no?
I told him for Father's Day he could come to my house and have a supervised visit. That's it. Now I'm ignoring my cell as he blows it up about how I'm "keeping P from him".

I googled it and it said after three DUI's in ten years, it is generally mandatory jail time of no less than 100 days, and a three year suspension of their drivers license.

He can only evade jail for so long. It's only a matter of time for him because, unfortunatley for P, it doesn't seem as if he'll ever really change. At least you'll get a break from him for a while if/when he gets locked up. That's one positive.
Wet and reckless=I'm a douche and paid a lot of money to my attorney instead of the back child support that I owe to get my DUI reduced to a lesser offense even though I was driving while intoxicated on alcohol and drugs and putting others in danger with my ridiculous antics.

I hate hate hate all of the radio commercials we have for some lawyer that specializes in getting you out of DUI charges. If you get a DUI you fucking deserve it, don't try and weasel your way out, be responsible for your actions, assholes. GRR!

I know. It's sooooo frustrating. I wonder how much he'll have to pay a fancy pants lawyer now?
And I bet he'll have a brand new $50K truck by Sunday.
