Yay! I am excited about this. We also need to decide if we should amend....it would probably get us a few hundred, but I'm not sure if it's worth the trouble.

Duchess1 we don't have an accountant, that's part of the problem! And I'm not sure I want to pay someone to find out that we might get pennies back, but at the same time I'm not sure we'll be able to tackle it on our own.
kershnic it would be a LOT easier to decide if we had health insurance that was taxed, those are the people who really need to be filing amended returns. If we had added me to her company's insurance when it became an option we would be getting back thousands by filing amended returns now. At the same time I'm like "why should the government keep money that is rightfully OURS, even if it is just a small amount?"

Oh, absolutely! As a childless couple it has been the obvious financial decision for us to carry separate insurance. Our individual policies cost combined about the same as family insurance at my work. Such great news for people who needed to make the opposite choice and can now get money back! I also think filing the amends is a matter of visibility to the issue.
I am however annoyed about the issue awkwardpenguin pointed out to me....even though we will still need to do 2nd parent adoption it will no longer be tax deductible. Lame.

Yeah, that part sucks and we shouldn't need to be adopting our own children in the first place, they should be ours at birth. However, living in a state where adoption is not even an option for us I would gladly give up a tax break just for the right to be my son's legal mother.
So question. As its now recognized federally no matter what state you live in, can M and I travel to another state to be legally married even though we reside in Texas?
