Judge says court clerk was in violation of his legal authority in issuing SSM licenses. Says Hanes does not have the authority to decide if PA's ban on SSM is unconstitutional.

Well, yeah, we kind of suspected that. That they were in violation of state law, but at the same time he has been arguing that it's about equal access, which is also law.

She made a public statement that she will not defend the statute in the ACLU's lawsuit because she believes the statute is unconstitutional. Don't know that I'd call that wishy-washy.

I'm mobile and miss my physical keyboard!
Well, I mean that she's not defending it in court, but she's also not really moving ahead to try to make the MontCo licenses continue, either. I *believe* she was against it when it started happening, but I don't have a source now.
