Amy Howe: In Plain English: The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn't comply with the new requirements, rather than all of their funding.

This is one of the things I hate about instant news coverage. Newscasters talk out their ass to fill the air because you can only repeat actual facts so many times.

Sounds like since there is no penalty for not paying, that's how you can just not pay.

Megyn Kelly just looked like she was about to cry over the fate of all the poor people in states who choose not to follow the HCA because they're allowed to opt out, and OMG they won't get Medicaid coverage. "Where will they go?" :-(

argh, CNN is saying that there are some folks with like 9 million dollars going to put up ads tomorrow against this. WTF, take your 9 million dollars and put it to something that can HELP people. You know, like habitat for humanity or feeding people. 9 million dollars will go a long way towards something more productive than television ads, for fuck's sake.

I've always liked Roberts, honestly, and seen him as not too partisan. And smart. But I see all of the Justices that way most of the time. I'm naive, I know, and I DON'T CARE!

Florida will be one of the firsts. Rick Scott is such a complete dickwad that this is exactly what he'd do. He gave back our high speed rail money after all so why not this too.

That was incorrect. If you don't comply with the mandate, you have to pay a tax. The court is saying that "forcing" people to pay this tax is constitutional under the taxing power of Congress.
Ok so what's the penalty for not paying the tax? Is it like any other tax?

"forcing people to pay taxes." That's sort of strong and ugly. I mean, we pay taxes so our government will function. We don't work for free right? Everything costs money. It's a simple fact of life.
