BOSTON —A creepy criminal who is breaking into homes and tickling people is on the prowl in Boston, but his victims aren't laughing.

Police in Boston are investigating a number of overnight break-ins in the Brighton neighborhood of Boston early Tuesday morning.

Two homes on Foster Road and one on Kirkwood Road were targeted during the early morning hours.
In one of the break-ins David Master said he heard screaming from one of his roommates. "He felt something on his foot and thought it was the cat," Master said. "He woke up to see a man crouched by his bed."
Master told the Boston Globe he and his roommates did not pursue the man. The man apparently walked in through their unlocked door.
Another victim, a Boston College student who didn't want to be identified, said the man police are looking for crept into his off-campus house a few weeks ago.
"There was a man in the room with a ski mask," he said. "We made eye contact and he immediately left, and ran downstairs and out the front door. It's definitely a very scary experience turning over and seeing someone in my room."
Detectives have been looking for clues in the neighborhood and all targets have been men.
His victims say he doesn't appear to carry a weapon and he never steals from their apartments.
Boston police asked anyone with information about the crime to contact them.

I don't understand not locking the door though. When I lived in the city proper, I locked all of the doors all of the time. I still do.
Since supposedly all of the doors have been unlocked, I'm starting to think it's someone these people know and he knows they don't lock. Unless there are tons of unlocked doors, he's pretty "Lucky" that all of the ones he's tried have been unlocked.

I don't understand all the unlocked doors. When I lived in Boston proper there is no chance I would have gone to bed without the door locked. Even now in the suburbs. Door gets locked before bed.
I thought if you leave your door unlocked its not a beak-in. You know, cause you don't have to break in. Its not a forced entry. And he didn't vandalize or take anything. I dunno what he would be charged with?

When I was growing up, there was a prowler in my neighborhood. I used to have very vivid dreams about waking up and finding that dude at the foot of my bed, wherein I would proceed to fuck his shit up.
Bottom line is, I would totally ruin tickle-creeper's day. At least, I would in my dreams.

starlily can probably confirm or correct me, but I believe the "breaking" part of "breaking and entering" is "breaking the plane" of a private place without permission, the use of force isn't necessary. I would assume he could be charged with battery, too, yes starlily?

"Breaking and entering" is more of a colloquialism than a legal term in a lot of places. In most states, the crime would fall under burglary statutes, and then it would depend on state law. In CA, a home doesn't need to be locked for it to be considered residential burglary. Yet a vehicle does have to be locked in order to satisfy the elements for vehicle burglary.

And I've seen "home invasion" vs "breaking and entering" more when reading about this. So I think even with an unlocked door, if you enter without permission it would technically be home invasion. Not a lawyer.
