Why would we leave it to the school to do anything--isn't this a criminal matter to be handled in the justice system? And theoretically, if the case can be proven in court, he'd go to jail so expulsion would be unnecessary, right? This is what I don't understand about colleges--why are we leaving investigations and punishment (or not) up to schools? It makes no sense.

The link I posted says the police were involved but didn't find adequate information, so they turned to the school to investigate. The school issue is also because they weren't told that for the first 10 days, the boy wasn't allowed in school, so the girl didn't go either and therefore wasn't able to take control of the story. The boy was able to take control of the story and get the support behind him and it seems like no one was supporting the girl. Everyone ended up believing she'd framed him.
In my short time dealing with a school administration as a parent, and based upon my professional experience, I don't have confidence that any school district anywhere could suss out a hangnail, let alone a claim of rape.

Yep, go pat yourselves on the back because this poor girl has mental issues, but hey the guy was "framed" and we wouldn't want his career ruined.

IME, school districts are not staffed by the most intelligent or competent individuals. Their primary concern is to keep things calm and quiet, and not give the majority of parents a reason to get riled up. I'm damn certain if the rapist had been a lower profile student, the allegation would have been taken more seriously. TBF, it probably would have helped if the victim hadn't lied at first about who the rapist was. This entire thing is a cluster.

I completely agree with you. The fact that the boy got to spread his version of the story all of the school probably helped a lot too. I mean, if they are all about keeping the peace why would they do something, or investigate something that a large portion of their student body thinks is fake? That is bound to cause problems they don't want. I just hate the atmosphere in general.
The part that sickens me the most is knowing that since there were absolutely zero consequences and he was able to spin the story the way he wanted it, this douche has ZERO reason to believe he actually did something wrong here.
And 1) that enrages me on behalf of the victim and 2) enrages me on behalf of any future victims because you just KNOW he's going to do it again and not think anything of it.
I just signed up to do the Title IX training (and, therefore, serve on the "adjudication board") at my university for two primary reasons: 1., initially they only wanted staff (like coaches) and administratiors on the board. The invite was not open to faculty. Hell to the no. 2., I don't believe schools should be investigating, ruling on, and punishing crimes in the first place. I understand why they'd want to keep everything in-house (and hush-hush) but I plan to make sure to ask every single victim "you know you can call the city police and not just the campus officers, right?" and do everything I can to keep other board members from asking questions like in the Hobart and William Smith case. This should be interesting.
