Someone here that has gone through the process can enlighten us, and I imagine it varies by state, but I am almost certain here that before you go through the process you need to determine what will happen to the embryos in any number of different situations. Or maybe also that depends on the clinic/practice?
I guess I have a hard time buying she didn't legally protect herself going into it, and therefore this sounds like some shameless aw-ing with a frivolous lawsuit, which is supposedly his mo anyway.

Does he want them? Maybe he just doesn't want her to implant them. Theyre embryos so they've been fertilized, right? Maybe he thinks they're "alive" and therefore are all ready his kids? I really have no idea. Maybe he is just bitter with the break up and is trying to be a PITA for her.
