I've been following this forum for a few months and you all seem to be a very intelligent group. I don't get to post too much bc I have a 3 yo and 1mo and I am on maternity leave now. My life is pretty chaotic now lol.
I have a car insurance question for you all. I was rear ended in April. I was 24 weeks pregnant at the time. I was sitting still at a red light in my accord and a full size Chevy truck w a metal bumper decided to not stop. He was cited at the seen. I was wearing my seat belt and had an instant headache. I had my H come pick me up at the seen and take me to the hospital.
Bc I was PG, the ER doc didnt want an X-ray. I spent the entire day in OB doing a NST and Ultrasound. This was a Thursday. The doc wanted me to take that day and Friday off work. I returned the next Monday as scheduled.
I'm in FL (don't judge lol) and the law says that my PIP has to pay 80% up to 10k and I had additional coverage of 2k for medical bills. My insurance covered all the medical bills
Also, my PIP paid 60% of my lost wages from those 2 days.
His insurance covered my rental for the 28days that my car was being fixed and paid the 6k worth of damage done to my car.
DS1 car seat was in the car at the time of the accident. Due to the extent of the damage to the car, they are agreeing to pay for a replacement seat.
They are also agreeing to pay the remaining 40% of my list wages.
Phew...my question is...should I ask for additional money in addition to the lost wages and car seat replacement? I've been dealing with crap related to this damn accident since April and it has caused a lot of stress and anxiety...during my pregnancy.
I am not looking to make a ton of money, but I feel my time and inconvenience should be monetarily compensated.
If I do request additional money, how much should I request?

Thanks everyone. I've never been involved with an accident and really don't want to deal with an attorney, courts etc. His insurance sent me a letter stating that they want to settle up. I want to wait to formally settle bc my health insurance got billed for part of the charges and will end up fighting those and I believe that once you sign settlement papers, you cannot try to recoup that money. So damn annoying and time consuming
If you want to sue, you can. Keep in mind that his policy might not cover the damages you're seeking so you would be trying to get them from the Chevy guy personally and depending on his assets... well... the old saying is "You can't suck blood from a turnip."

I was in a similar accident. The insurance co of the guy who hit me offered to pay me 2500 to release all claims, and that is after they fully pay MY insurance company for our car, time off work etc. we didn't ask for the money, they just sent us a letter offering it.

She can't sue? Or she can't sue the driver? Could she still sue the insurance company?
She can't sue the other driver. In no-fault states, the only recovery is from your own insurer. She could sue the insurance company if she has a claim for bad faith, but it doesn't sound like that's the case.
