I am normally more active on MM, but thought you ladies may be able to help me.
My friend divorced her H. After some time, they ended up reconciling to see if their relationship could work and he moved all of his stuff back into their home (which she took ownership of in the divorce). One year later, they have split up again, and his stuff is still in their garage. She has repeatedly asked him to come and remove his belongings from their basement and garage, as her garage is not usable with all his crap inside.
She sent him a strongly worded text (again) asked him to remove it by 11/21, giving him 2 weeks to do so. My friend is somewhat of a pushover and her ex knows this and my assumption is he doesn't take her seriously.
If he doesn't come to claim his stuff by 11/21, would she get in trouble (legal wise) if she were to remove all his stuff and just left it outside her condo?
Not a lawyer, but my guess is, that she would face legal repercussions as he is probably considered a tenant. I'm also guessing that she will need to follow the eviction procedure for her city/county.
Agrees with winecat, however if he has moved out otherwise it could just be subject to normal tenant laws of keeping stuff. I'd consult an attorney who specializes in landlord tenant law
Is there any way she could get this done without consulting an attorney? It infuriates her that his stuff is there, and he has no motivation to move it.
Eta- "stuff"= ATV, his fishing and hunting equipment (tons of it), a deep freezer full of game meat, etc.
Yes she could face legal ramifications if she doesn't follow her states eviction process. But she can probably just google the process and evict him without an attorney.

There's a landlord tenant hotline here that helped me when I had a tenant that I needed to evict. She needs to follow all the steps to a T.
