We had two local employment attorneys review the non compete and both said it’s enforceable. The third and fourth had conflicts so we gave up.
If DD didn’t have her medical challenges we would consider moving out of state for two years (he can work in several states where he hasn’t had clients) but it’s too much to uproot her and the other kids and my mom.
We are paying cash for two kids in college so he can’t take a pay cut...
If he travels every week anyway, why doesn't he work out of state and travel there M-F? Of course, if it is not consulting then he would have to pay for travel and a cheap apartment.

I don't think all non-competes are ridiculous, but that could just be because I'm trying to get the Asshole to sign one right now. All his includes is clients that were in our agency for 2017 for 2 years following the end of his employment. That's it.
waverly - we have discussed that. He decided not to do it - but he was close to trying this. It stresses me out but I think we could do it for two years.
I know a guy that did that for a university position. I didn't understand why because the university only paid 60K or something. His wife and daughter lived in Ohio. He moved to North Dakota and then the Michigan, and then somewhere else. He had a one bedroom with probably a bed and a chair in it and some paper plates. But at least with the Michigan job it was within driving distance, and the university let him leave early on Fridays sometimes.
It’s any company anywhere in the world ever - but the lawyers said if DH works in a related industry in a state that he has never done client work, he should be ok. The catch is that some of his clients have a presence in every state....so there could be a legal battle.
He just got pinged by a consulting company that withdrew their offer and for some reason they might be game to fight it this time. This is the third time they have reached out so I’m not super hopeful.

I mean, you cannot deny a person a right to earn a livelihood. That is effectively slavery or indentured servitude or something illegal. So no way would it stand up. But I get that the perceived battle and cost over it is problem enough even if a judge eventually struck it down.

And he makes a very good living, right? That's so hard. Stay in a bad work environment and earn a good living, or leave and risk a terrible legal battle and bankruptcy. They are the absolute worst.

That's so ridiculous. I know it's easy for me to sit here and say that job is not worth it being in my late 20s, only 2 kids under 5, and looking in from the outside, but you both deserve better than what that job is doing to your lives.

My SOS: so I tasked DH with buying a new couch. My main criteria was that it be comfortable. The couch was delivered today. It is not comfortable as my feet can't reach the floor. When I brought this up with DH, his response was : "well yes, that's what happens. The couch is designed for someone that's taller. You are pretty short.". So does he think I'd magically grow taller?!?! And no, I'm not that short, we have 3 other couches where my feet can touch the floor.

Seriously. If they have a product or service that I would possibly use, I want to avoid them also.

Jesus it keeps getting worse. Can he quit for a while then go back to work for them for a bit or forever under them new contract without the non-compete?

Yup. I don't know who to blame more though - our decorator pre-selected 3 couches and DH made the final pick. How could our decorator not figure out that the dimensions of the couches she picked wouldn't work for me? And I had brought that point up specifically before - i.e. I need something where my feet can touch the floor.
Worst part - we bought it on final sale, so no returns. I'm going to build a wall of cushions so that I can sit further forward so that my feet can touch the stupid floor!
traveltheworld , We had something similarly happen with a toilet recently. DH replaced one that didn't work with a super tall one where my feet dangle, and neither of the kids are tall enough for it. Cue needing a step stool back in the bathroom. I am a grown woman and its my house too, I don't want my feet to dangle. He doesn't understand why I am upset.

That's kind of what I was thinking. Especially since they dropped the lawsuit against the other guy that left if he came back. Clearly I'm invested so you'll have to let me know how it goes.
Plot twist - he just jumped three levels at work - crazy HR promotion. Please tell me it comes with comp, too? If he can totally run his own engagements like he used to he MIGHT be happy with this place. It’s the best travel situation as they are down with things like him flying home if anyone pukes or him doing kid appointments when he is in town on Fridays. Or going in late this week because of Donuts with Dad. Cross your fingers ladies.
mustardseed2007 - he seems like it? I can’t tell though. We hosted a party last night and I went to the ER first thing this morning, then we were running separate errands, I was dropping kids to play dates while he ran...I haven’t really seen him. I keep thinking he MUST be though? I mean, this has to be GOOD.
