For those with kids with an IEP, do you know anything about whether a kid can qualify for an IEP if he passes (is on grade level) the school's assessments, but is doing very poorly in class (bad grades)? My first grade son has ADHD and I think he should qualify for an IEP through Other Health Impairment. His grades were terrible last trimester and he is often not able to participate in class. They say he can only get a 504 because when the school did their various assessments earlier this year, he was at grade level in all areas. This seems like bull shit to me because if he is *able* intellectually to do various tasks but cannot learn or show that in class, to me that is clear educational impact. Any guidance or wisdom here?
I read through the other post you made, and if I'm understanding the timeline correctly, you asked the school for an evaluation, they did one and determined that he didn't qualify for an IEP. Then you had an outside evaluation that resulted in the ADHD diagnosis. I think it's perfectly reasonable to ask that the school revisit his case, and it sounds like you really need the school psychologist to observe his behavior in the classroom to see what's going on. I would ask for that, and then proceed from there.
