DS is 37 inches and 28 lbs - I feel your pain. Most of his pants these days come from The Children's Place, because they have adjustable waist tabs. He just outgrew the smallest setting - and now the 2Ts are too short, so I am sure he will be back to the smallest setting on the 3Ts!

DD is 26 lbs and 36" tall too! Cherokee at Target actually has some cute skinny pants that look like jeans but have an elastic waistband. DD is potty trained and toilets herself at school (with the exception of poops.) She wears 2T and it fits well enough. I just bought 2 pairs a week or so ago.
We also buy jeggings whenever possible from baby gap or children's place. Because of length, 3T's fit a little better length wise. They're a little baggy, but 2T's hit her ankle and will be too short soon.
Regular gap skinny jeans are okay too, but we have to cinch the waist with the interior buttons and it doesn't lay quite as nice.

I bought DD some Osh Kosh skinny jeans from Target that fit really well. She wore a lot of leggings and dresses. Old Navy and Children's Place fit pretty well too.
