I don't disagree with what Lucy is saying, I just think it's sucks ass that it's only being floated as an option because these schmucks are famous. If we think this is a good thing, we should push for it for everyone, not just the famous.
They are liars and haven't learned their lesson. They are trying to protect their dwindling remaining assets outside of the law not realizing the courts have information outside of what they themselves provide. At least that is my speculation.
But they have an ARMY of lawyers and a image consultant and a million and one people working for them. HOW could no one say " Hey guys hiding assets will bite you in the ass and pretty much make jail time for both of you inevitable"

She knowingly committed fraud, for years.. I think she should go to jail b/c... of the law. I don't see what having children has to do being sentenced appropriately based on your crimes.

Well clearly the very real possibility of going to jail has not made either of them "learn any lessons" or worry about their children since they lied on the latest forms so what the hell is Teresa going to learn from getting in house arrest? not a damn thing.
Also, my understanding is that federal sentencing guidelines are strict. So basically, if they plead to or are found guilty of certain charges, the judge is supposed to sentence accordingly. I could be wrong, since I'm not a lawyer, but that's how I've seen it explained.

Right?!? Like- Hey guys, maybe you should get someone else to head up your "team" seeing as how nobody called them on their bullshit. But nope, they only like to surround themselves w/ head-nodders & cohort BS artists.

My contribution to this thread... is that I do think sentencing guidelines are super strict.
My brother pled guilty to a US/Canada border gun possession situation, and the guideline was 24 months firm. He ended up with 6 months, followed by half way house time, only because his judge was close to retirement and was not concerned with the professional repercussions of not following the guidelines.
While I don't think she's a genius, I think that ditzy persona on the show is an act. I think she knew the deals were not on the up and up and signed off anyway. Her kids are the real victims in this scenario.

They used to be extremely strict with mandatory minimums, etc. But in the last 5 or so years (?) judges have been given much more leeway in sentencing (whereas before it was convicted of crime x = y number of years in prison, no matter what, as a minimum). The change is a very, very good thing IMO.

I have a friend who follows Milania Guidice on IG. I side eyed the shit out of that. One, you're a grown woman following a kid on IG. Two, why does she have a public IG with 10k+ followers?
I know this is wrong because she's so young but I really don't care for that child. She's a horrible brat and Theresa seems to encourage her bad behavior. Maybe the girls will go to someone who will help her shape up and not turn into a wretch of a human being as an adult.

Well, sure, and under the plea agreement the DA will recommend their sentencing in the standard range but, ultimately, it is up to the judge. And if they continued to hide assets after the plea agreement I wouldn't be surprised if the judge found that to be an aggravating factor- of some sort. Curious to see how this plays out.
Also, this is why you should NOT fuck with the IRS. There was a reason Al Capone got away with bloodshed but was later nailed by the IRS where he actually did time. Eastern State Penn. still has his cell on display, lol.
I hope she does get house arrest. I have also heard that if they both get prison sentencing, they may try to get them to serve at different times. I didn't even know that was a possibility (and may not be) but I think I heard it on WWHL or something, I can't recall.
Would normal people get this opportunity? Seems like if you and your husband are found guilty of something and jail is awaiting you, the judge wouldn't give a shit and just toss you both in jail...not put one in and let the other wait it out for the sake of your children.
There was a case of insurance fraud where the two couples involved (no one famous) were allowed to do their sentenced staggered so a parent from each family was home. But it was an extremely sympathetic case, one couple had no health insurance and when they were in an accident together the insured couple allowed the injured uninsured husband to use the DH's insurance card so pretty much it was wrong but not something a lot of people felt too badly about.
