It is really hard keeping her rested. And she just wants to be with us but that involves on the couch and I dont and they dont want her jumping on anything.
I'm so glad to see this update. I have no idea if this is an option, but it seems like the first vet should have some liability for the treatment that had to happen as a result of his negligence?
Dog liability really varies from state to state. In CA, dogs are viewed as property, so malpractice is treated like a property crime. So, for example, if it were me in this situation, I would sue for the $500, plus any additional costs I incurred as a result of the delay in treating her, plus any diminished value to my puppy's health (I.e., if it shortened her life span by a year, I would divide her overall value by 1/12 and seek that). Plus probably fraud and negligent intfliction of emotional distress and a bunch of other stuff that wouldn't stick but that I would add anyway so the vet would have to notify his malpractice carrier and because I would want to kill him and would probably just settle for suing the fuck out of him instead. But I digress. What would be reasonable, in my state, would be the $500 plus any extra cost resulting from the delay. And if the vet didn't pay it voluntarily, I would probably sue him in small claims court.
I wouldn't write a negative Yelp review if I was thinking about suing someone, because it makes a counter suit too easy. But, if I wasn't going to sue, I might. CA also has anti-SLAPP laws, which makes it hard for business owners to sue customers for honest reviews (among other things) because it obligates them to pay attorney fees if they bring a defamation suit and lose. That's pretty state specific, though, and I might feel differently elsewhere.
So, all of that is a long way of saying that it's impossible to give even general, hypothetical advice because the area of law really varies from state to state, and you may have far more (or far fewer) rights in your state. You might want to at least try a few plaintiffs lawyers to see if someone will take it on contingency. But, if not, small claims court is very easy to navigate and a great option for claims in this range.
She is a handful! She hates being crate kept, though she did fantastic last night all night, when she has slept in our bed for the past 5 years.
She is doing super well with her pills and she is a ball of energy.
The vet wanted to send her tissue samples of her stomach and intestines out to be checked out. So I gave the go ahead for that to be done, it will tell if she has any underlying problems.
