I'm not even going to lie about it, I'm in my late 20s and I've driven after two drinks. Sometimes I feel like I'm even more alert than otherwise after a tequila sunrise. I wouldn't risk it if I felt like I was remotely intoxicated. I'd wait it out until I sobered up if I thought I was buzzed.
Even as a DD I've had a drink. I don't think anyone should be driving around if they're drunk, obviously, but everyone has a different tolerance level.
wrt the bolded statement- this is the shit 16 year olds say... just because you think something, doesn't mean its true. By definition alcohol is in the depressant category of mind-altering substances, meaning that it depresses your system, and makes reaction times/cognition slower. So regardless of what you feel, you are not actually more alert if you have had something to drink.
(ftr, not trying to pick on you specifically but lots of people say this, and its just not true, I wanted to point that out to anyone reading... the science just proves it to be wrong)

well, its a pretty charged subject because of how it effects people (meaning many of us have had loved ones die or be seriously injured from it), so its bound to be more drama than something about what makeup brand you use...

We have plenty of traumas whose BAC is less than .08. They're in the same position as those that are over the legal limit, lying in bed, on vents, massive brain injuries or bleeds, and may not live. Sometimes seeing the heartbreak in their families is almost unbearable. IMO, it's better to be safe than sorry.

The law does say that it's ok. Personal opinions and morals are different than the law.

Don't flame too hard but I honestly didn't know one drink affects people that much. I thought I'm safe having one beer and then driving, I actually thought it was responsible (that's why I thought they had .08 limit so people can have one and be okay). Looks like I was wrong and won't be drinking even one before driving anymore.

It depends on many factors as already mentioned. Personally I know one beer doesn't affect me. That doesn't mean it won't affect you or anyone else differently.
I'm not at all saying that things can't or don't happen when you're below the legal limit. But if it was that common or considered that much of a threat then there would be a lower limit or zero tolerance whatsoever.
So, what do you do when the cop asks if you have been drinking? Lie?
It's a fairly simple risk/reward calculation - drink, and enjoy the alcohol, and put yourself at risk of a DWI or DUI. Or, avoid the enjoyment of an alocoholic beverage, and avoid the risk.
The reward is minimal, and barely mars your life to not have it (the alcohol - really, we're all adults, and, hopefully, not addicted to alcohol, so none of us need it for anything more than a bit of enjoyment or enhancement to an evening/meal). The risk is _massive_ - it goes well beyond simply getting caught with alcohol in your system, it includes the various things that can happen because the alcohol impairs your reaction time and your cognitive processes. Even one drink has some impact, although it might be less than what is written as the "legal limit". And by the time you "feel" tipsy, you are _well_ into the range of significant impairment.
So, it comes down to a huge risk for minimal/negligible reward.
It's a calculation that puts me firmly in the no alcohol if driving camp.
According to multiple cop friends, yes. If you say you have been drinking they usually will automatically do tests and/or a breathalyzer. If you say no and/or refuse a breathalyzer they can't do a test until they bring you into the station, if they chose to do that. I'm not saying that that's what I would do, but that is what I've been told you should do.
As for the rest of the stuff, I'm done arguing it. I'm not an idiot. I'm a health teacher and have heard and taught all of this stuff before. So I don't need more lessons on the effect of alcohol on different parts of your body and how it effects your driving. Most people know all of this already.

Like I said, I'm not saying that I would do it, but that's what I was told. I just looked to be sure and the state I'm from is not an automatic arrest for refusing the test. However it is an automatic license suspension for 12 months, so obviously you wouldn't do it unless you were really drunk and would be completely screwed by a breathalyzer, where waiting for a blood test could potentially help you. I'm not at all condoning that, just saying where I think they were coming from with that "advice."
I don't want to quote beachy since there is so much but yes, in Nys if you refuse it is an admission of guilt, however if you would hve been way over legal limit it does work out in that persons favor. They will most likely get a suspension of a year, but can qualify for conditional. They will get a fine, have to attend drinking drive program, victims impact program, and now they would get the ignition interrupt system in their car for a year.

It might be worth mentioning that the US has the highest allowable blood alcohol content permitted while driving compared with the rest of the world. (http://www.icap.org/portals/0/download/all_pdfs/icap_reports_english/report11.pdf - this is a touch dated, 2002, but even still)
Some countries have zero tolerance. Many are in the range of about half of what the US allows.
Which leads me to the conclusion that many other places have determined that impairment begins well before it is acknowledged legally here. Which feeds my personal zero tolerance belief.
I'll admit, I don't publicly fuss at someone who chooses to drink one or two with a meal or over an evening and still drive. But I won't accept a ride from them, either. I can't control their behaviour (especially as that one or two drinks are unlikely to get them to the point of driving illegally), but I can control my actions.

I'm no lawyer, but I'd plead the fifth or invoke my 31 rights before lying to a cop...particularly because FSTs, BACs and BrACs tell a pretty accurate story.
