I'm torn about this article. They make a good point that the prosecutor's complaint seemed to misinterpret the ME's findings. But not a single one of the authors is even a pathologist, let alone a forensic pathologist. They seemed to be blaming the ME for the prosecutor's writing, and didn't seem to have a good understanding of what goes into writing an autopsy report. And they didn't really address the actual autopsy report, just the legal complaint.

The point of the article was to highlight and condemn how "medical authority" can be used as a weapon in white supremacy. That comes from both what doctors themselves say and how that information is interpreted. Race-based medicine is certainly problematic as I'm going to assume that like the rest of us when you were in med school you learned that "black people are more likely to have hypertension and you should prescribe them calcium channel blockers" without a deep dive in to structural racism.
I think the authors make it pretty clear that the headlines were problematic and not the entire report....
On May 29, the country was told that the autopsy of George Floyd “revealed no physical findings that support a diagnosis of traumatic asphyxiation,” and that “potential intoxicants” and preexisting cardiovascular disease “likely contributed to his death.” This requires clarification. Importantly, these commonly quoted phrases did not come from a physician, but were taken from a charging document...."
"As per standardized medical examination, Floyd’s underlying health conditions and toxicology screen were documented. These are ordinary findings that do not suggest causation of death, yet headlines and the May 29 charging document falsely overstated the role of Floyd’s coronary artery disease and hypertension..."
"By inaccurately portraying the medical findings from the autopsy of George Floyd, the legal system and media emboldened white supremacy, all under the cloak of authoritative scientific rhetoric."

I am pretty sure we all have someone who comes to mind when reading this.
“It’s a balancing act between being both woke, and fully supportive of the people I call everytime I think I see a suspicious person in my neighborhood,” said Smith.
"By inaccurately portraying the medical findings from the autopsy of George Floyd, the legal system and media emboldened white supremacy, all under the cloak of authoritative scientific rhetoric."
I suppose it's no surprise that the only time they claim to trust science anymore is when they think they can twist it to support their world view.

Who is the "they" you’re referring to? I think it’s dangerous to think that white supremacy is only something that equals hood wearing KKK science denier idiots. The point of the article was showing how easy it is for science/medicine to be used in a way in mainstream headlines to blame victims and strengthen white supremacy.
I’m pretty sure there are plenty of "liberal" people out there that have read headlines about Black people being more likely to have hypertension and have never thought to think about how false race-based medicine is another form of empowering white supremacy.
So let’s stop trying to pretend that only "others" uphold white supremacists views and ideology and that it isn’t a fabric that runs throughout our society.

Watching the local Houston news and the lines to pay respects to Mr. Floyd is hours long. It is 95+ degrees. I am glad to see all the support for George Floyd, his family and the movement that 400 years of oppression and the lack of justice has spurred.

I showed a video on this topic in my affinity group (middle school) earlier this year and this point came out loud and clear. It was a total eye-opener for lots of people, myself included.
"Hello babies. Welcome to Earth. It's hot in the summer and cold in the winter. It's round and wet and crowded. On the outside, babies, you've got a hundred years here. There's only one rule that I know of, babies-"God damn it, you've got to be kind.”

There were protests in Syria, Russia, and Lebanon regarding Mr. Floyd so you know the US has done fucked up. Insane and amazing. Humans are such fucked up creatures for real for real.
Another night club employee confirms that Chauvin and Floyd knew each other and clashed over Chauvin’s treatment of night club patrons. This could definitely be used to show intent!

There we go. That makes a lot of sense but they still need to charge the jury with the lower level manslaughter charges to ensure a guilty verdict. Unless tons of people testify to that, intent can still be tough.

Damn, so this doesn’t potentially help with a first degree charge?
In theory, yes. Unfortunately this could also give credence to the idea that he was just a “bad cop”/“cop with a grudge” and downplays the truth that our entire criminal justice system is built on a racist construct.

When I first read this I was worried about that. But I think the fact that it took awhile for this to come out was helpful. It gave the movement time to gain momentum and remind white people that this isn't just about George Floyd, there have been countless others before him. I think if it was known right away it would have been easier for them to sweep this under the rug as a personal vendetta. But it's bigger than that now. Hopefully.

I still worry that this will be the Fox News/OAN taking point — you know, “the libs want to abolish police departments and run lawless because of one bad cop!” I do sense that even conservatives are going to throw Chauvin completely under the bus, even more than they have already, to prove this point. And he can go ALL the way under the bus, because these statements further demonstrates his long history of racist actions. He needs to be locked up forever, and if this evidence furthers that, then I’m not upset about it.

No, not really. I would easily argue, so what? Alot of people have arguments and just because they knew each doesn't take away from the fact that he was a police officer, responding to a "crime" and was acting in a police capacity. That police capacity is a good argument for no intent nor an intent to commit a felony which typically what 2nd degree falls under I say that argument not that I agree with it but it is an argument I would as a cj defense attorney.
Intent by a uniformed officer in any capacity is incredibly difficult to prove.

In Minnesota, first degree murder requires premeditation (pretty sure this is the case everywhere). IMO, it's more helpful toward proving intent.

The "one bad cop" narrative doesn't stand up to the hundreds of documented examples of police brutality recorded and disseminated in these past few weeks. The responses to protests alone show systemic violence and racism even without the original george floyd video.

In WA our governor had stated that there is too much conflict of interest for the Tacoma PD & prosecutor you investigate and prosecute the officers involved in the murder of Manuel Ellis.

That is in all states, the requirements are all the same. The issue is that the defense can easily argue that he was working in the capacity as an officer and happened to come across him, which is probably what happened. It would be incredibly difficult to imply intent with a working active cop because there are so many potential "arguments" that imo will be difficult to prove. It would be stupid of the DA to charge him like that They would also have to have the other cops with him say that he had a beef with him and/or were knowingly knew something was up.
I don't agree with the law a lot but under the umbrella, this isn't 1st degree murder. Sorry

Gee, you fucking think? Lol. The Das and the cops work hand in hand. When a criminal trial begins the affiant aka arresting officer sits at the table with the DA. They all know each other intimately and the DAs are elected so they have to look "tough on crime." It is all a rouse.

Yep. I don't see any universe where he's charged with 1st degree murder. I think 2nd degree is a little optimistic, TBH.
Louisville police release police report on from night Breonna Taylor was killed. It's virtually blank, citing no injuries and no forced entry. Seemed to have forgotten about those 8 shots and the no knock warrant.
