If there were intoxicants in his system wouldn’t an autopsy have shown that?
Toxicology reports can take a while to get back, potentially as long as several weeks.

The ME report quoted above is just the prosecutor's summary that they included in their official complaint for the charges. In my opinion, it's way too early to rule out asphyxia. Based on how it's worded, I'm wondering if the complaint is summarizing a verbal, hypothetical situation.
Either that or their ME sucks. I want to give them the benefit of the doubt, but the entire state is iffy at this point.
Now I’m conflicted- The official complaint says that they couldn’t find a pulse and then continued kneeling on him for several minutes. Doesn’t that demonstrate intent to kill?
Possibly, but as others have said intent can be very difficult to prove especially for the boys in blue who had to restrain the man for “safety reasons.” This is the best charge for a conviction, bottom line.

Nothing will change until the boys in blue mentality stops. This is why I love the Philly DA who was a long time public defender. He took fucking notes and fired 30 assist DAs his first day because they were dirty as hell. It won’t change until the higher ups do something. Sucks.

Not necessarily. It's mostly a diagnosis of exclusion, meaning you have to rule everything else out first.

I’ve been watching a few different live feeds and it’s interesting to see how the protests are different. At the site of his murder at 8pm, when the curfew started, it was completely peaceful. At the site of the 3rd precinct that was burned last night, protesters are advancing on the police and being tear gassed and flash banged.

Right, but they don’t typically release the report or make any conclusions until everything is back. Tox screens only take a day or two so if it isn’t there then it isn’t .
