The judge denied request for acquittal or new trial. Also cleared the worker Josh tried to pin this on. Judge said ample evidence it was Josh and Josh alone who viewed the images. I really don't think people have made enough of the fact that Josh named another human being as a potential culprit when he knows he and he alone did this. He tried to take down an innocent person. He is evil, pure evil. I will be very upset if there isn't a double digit year sentence. People keep saying that will help ensure his kids are grown and out of the house....except they don't leave until married, the girls at least and we know Josh is not above assaulting family/incest. If he could get 30 years then I think all kids will be gone, but 20 or less and the younger ones, who are girls, might still live there, though I guess they will be too old for his tastes then.

Eta Just adding I know he can't get 30 yrs, just wishing he could.

He will. He's been in custody since the guilty verdict in December and he will leave in custody today to serve whatever sentence he is given.

That was from when he was released from arrest up until trial. After quilty verdict he was taken into custody immediately.

I feel the same way. Not that justice in this case makes up for what happened in TX, but it will at least give something else to focus on.

Incarceration is the only hope of his children growing up without him in their home.  I hope he gets 20+ years so they are grown and can leave the home once he is out.

They are breaking for lunch, but the upshot from the morning is that the defense had 22 objections to the pre-sentence report that they went through this morning. Posting them below from the Sun:

Objection 1 was ruled not specific enough and overruled for being too broad.

Objection 2 was in regards to the victims involved not being personally victimized by Josh Duggar, but it too was overruled.

Objection 3 was sustained.

Objection 4 was in regards to a level 2 enhancement for distribution, and both sides argued the particulars, with the court ultimately ruling to sustain it.

Objection 5 involved a level 4 enhancement of "sadistic or masochistic conduct" based on some of the details of the images that were downloaded.
The judge overruled this objection.

Objection 6 was in regards to an application of a Level 5 enhancement pattern of sexual abuse of a minor, and involved an argument about Josh Duggar being a minor himself when he allegedly molested other minors. Josh was never criminally charged for those alleged crimes.
The judge overruled that objection.

Objection 7 involved the number of images of child sexual abuse material that were downloaded.
There were 725 images, and it takes 600 images for a Level 5 enhancement to be put in place.
The lawyers and judge went back and forth and ultimately, Judge Brooks determined that there were not enough to reach a level 5 enhancement.
The judge determined that he will rule on objections 8, 9, 15, and 19 later.

Objection 10 was ruled moot, because Objection 6 was overruled.

Objections 11 and 12 involved striking information about the Ashley Madison cheating app scandal and porn addiction, with Josh Duggar's lawyer Justin Gelfand arguing that the infidelity had nothing to do with these crimes.
Back in 2015, Josh was discovered to be a member of the app following a data leak. He later admitted to infidelity.
Dustin Roberts argued that he wanted it considered because it proves "moral shortcomings" when Josh has claimed to be a family man.
The judge agreed with Gelfand. It was noted that addiction to porn is relevant to determining programs related to treatment while incarcerated and later on, but that there is nothing illegal about adult pornography.

Objection 14 involved financial information from Josh Duggar not being current, but it was updated so the objection was withdrawn.

Objection 16 was in regards to restricting contact with minors. A probation officer recommended it and the judge decided to rule on it later.

Objection 18 involved fees per count and was dismissed.

Objection 20 was withdrawn, with no restitution discussed in this case.

SENTENCING IN: Josh Duggar has been sentenced to 151 months in prison, which is between 12 and 13 years.
