In a competing opinion late Friday, a federal judge in Washington state ruled in a separate case involving mifepristone that the drug is safe and effective. He ordered the Food and Drug Administration to preserve “the status quo” and retain access in the more than a dozen states behind the lawsuit seeking to protect medication abortion. It seems inevitable the issue will move to the Supreme Court, and the dueling opinions and appeals could make that sooner rather than later.
Which is great because Thomas should be impeached and removed before then.

I'm going to plug women on web again. It's a British org that will mail pills to people in areas with restricted or no access. I've had friends use them with great success.
I never thought that one day I'd be living in a Muslim country and have more control over my body than in USA. Although the writing was on the wall for this, I still gasped aloud in public.

Good reminder. Women on web only sends outside of the US (the doctor who writes the prescriptions isn’t British).
For the US visit Aidaccess.org to get pills in all 50 states (both mifepristone and misoprostol). You can also get pills to save for future use if needed.

From a legal standpoint this seems like it’ll be interesting going to the Supreme Court.
There are currently 2 distributors of mifepristone in this country. Danco and GenBioPro. This case specifically named Danco. GenBioPro has specifically said it will keep distributing mife no matter what.
Anyway, all these fuckers just really scare and confuse everyone which is obviously the point, even if laws don’t actually change. There are so many nuances to these laws that people are just afraid to do anything.
But at the end of the day people are going to keep having safe and effective abortions regardless because the law has a track record of not protecting people in this country. We’re going to continue on.

Yes! I definitely think they weaponize the laws in an additional way as a form of paper terrorism.
I haven’t read the opinion yet, as I just can’t stomach the idea right now, but if the basis of the suspension is the FDA approval process doesn’t this call into question the approval of other drugs and the process itself?

They are going after the very fabric of our regulatory processes. Any way they can.

Let’s make viagra illegal too. I know, not the same but my level of rage around this is next level.
Marijuana is legal in several states despite being contrary to federal law. Can states do the same for mifepristone as a workaround to this ruling?
So I’m not a lawyer so I don’t understand everything, but this is unprecedented because it’s changing what a federal agency does. So obviously states have protected access. However, in general drugs aren’t allowed to be distributed in the US if they aren’t FDA approved. I believe there are a few exceptions to this though. So even if states say yes we protect abortion access and mife and miso, if the company (Danco was named in the lawsuit and the other distributor was not) is not or does not distribute the medication because it’s no longer fda approved then that’s where the problem is obviously.
I know independent clinics and I know where I work have said we’ll keep using mife as long as we have access to it even if it’s no longer fda approved, so yes people will still use it but that can’t happen if it is no longer distributed.
So I’m not a lawyer so I don’t understand everything,
I am a lawyer and I still don't understand this ruling because it just throws out long standing precedent in so many areas -- it's a completely bonkers opinion!

Yes. This is a feature, not a bug, for the people who have been attacking regulatory processes and institutions.

Yes! I meant to say I’m not a lawyer but I know you are lol. Although I’ve always known the law is bullshit because it used to be legal to own Black people, I’m realizing just how made up it all is. We don’t live in a democracy and people can just make up whatever shit they want.

Oh, thank you for that correction and new org to recommend. I had thought WoW expanded into the us.
It's terrifying to think how many medical treatments (beyond abortion) might become unavailable to women because the hateful Right wants to control us.
It definitely begs the question, if judges can force medications off the market, what will they go after next? I absolutely expect that they will try this with contraceptive pills at some point.
This is why I've always been fearful about the status of Griswold in the post Roe world.
I don’t have a subscription, so can’t read, but your first sentence is so true but makes me so mad. If this was happening to a blood pressure medication, more people would be more vocal that one judge should not be able to overrule the FDA. This issue is absolutely critically important, but more people should be talking about what this could extend to. Basically any treatment that a judge might consider “immoral” or of questionable use could certainly be in jeopardy.
After reading Empire of Pain about the opioid crisis, I believe that questionable things can certainly happen in the FDA, but that’s not what is happening here. And if there WAS a valid concern, it shouldn’t be canceled by one person without a medical degree.
Idk. Maybe I’m jaded because my whole family of origin works in the pharmaceutical industry, but my impression of the many assholes I had to see at bring your family to company events and trips over the first two decades of my life is that there are an awful lot of GOP-supporting, taxes for thee, but not for me folks there. And yes, it’s great for those companies to say something because this decision was absurd. But also? Duuude. For big pharma to decide NOW after we’ve already fallen off the damn cliff to say something feels very too little too late. Like how do they think we got judges like this on the bench? What was your money doing in 2016? Where was this letter a month ago?

I obviously agree and lots of people have been silent and complicit for way too long. But I shared the article cause it’s pretty telling of how absurd the TX judge ruling is if even they came out condemning it. Cause like you said some of them probably voted for Trump. Trust me, I am not cheering for pharmaceutical executives.

I heard that the judge cited Wikipedia and used some eugenics language….plus he straight up had facts wrong.

I read the opinion on Friday night. It was awful to read and honestly it was difficult to follow because of the ridiculous and dehumanizing to pregnant folks..
I am part of an organization that has legal counsel and the breakdown we received from our lawyers was hard to read because it gave us indepth detail about the decision point by point and paints a grim future.
