This is probably going to come out super insensitive but of course the family and their lawyer are going to stand by their argument. The family want to place blame somewhere but not on the grandfather, they want the cruise ship to be at fault and of course the lawyer is going to say that the grandfather didn’t lean out the window/know it was open. That is the whole basis of their lawsuit.
I still don’t see how the grandfather didn’t know the window was open or not. Whether he leaned out there or didn’t, he went up to the window first, was there for some time and then picked up the grand daughter. He didn’t pick up the granddaughter somewhere else and walk to the window and directly put her against the railing.

They are dragging this through the media themselves. Fighting for millions isn't how you save face. Dropping your case would do that. Then they could slink away quietly and mourn.
I've never lost a child, so I don't know what kind of fight would be in it for me. Even if I thought / knew my father or FIL had made a poor decision with letting her sit on the bannister.

I feel like that are channeling their anger at the cruise ship and just can't let it go. Maybe just aren't ready to start really grieving. I imagine fighting the cruise ship is easier to deal with than the loss of a child.

This is a total guess, but I think it might be easier to cope emotionally thinking this is the fault of a negligent corporation than come to terms with the fact that your father's actions caused this, i.e. willfull denial because reality is too painful.
